Credit Repair Background:
The default was because of a loan from Westpac. It was for business purposes but done under a consumer agreement. Domenic and his wife were instructed by Westpac to change where payments were being made into to an account that was under his wife’s name. Westpac provided them with Bpay details and they made payments using these details but they were incorrect. Westpac never contacted Domenic or his wife to inform them of the unreceived payments or the default. They never received any default notices from Westpac, but they had received one reminder letting them know a payment is late.
What were any challenges with the creditor?
Panthera Finance refused to remove the default at the time of the investigation.
Why was the listing removed?
Domenic and his wife claimed that they were making payments towards the loan but for some reason they were not being applied correctly. Domenic claims Westpac advised them to make repayments into another existing Westpac account. Domenic did this and provided evidence of this. Panthera Finance agreed to removal based on this, the fact that the account had been paid in full and to resolve the existing FOS complaint.
Summary:
