Rebecca and her husband had been arguing with an energy company for years. They kept paying. The company kept saying the account was unpaid.

At one point the retailer admitted the money they’d paid had been put on a different account number. Even then, it didn’t fix things. After going round in circles, they offered to pay a portion of the disputed amount just to end it. That went nowhere too.

Diagram of how this case was resolved: payments on wrong account, asked for the notices, notices could not be found, removed in 29 days

A default for about $2,300 ended up on Rebecca’s file and was later bought by a debt buyer, Lion Finance. The whole saga took a heavy toll on her.

What it was doing

The couple wanted finance. As long as the default was there, that wasn’t happening.

What we found

We asked the debt buyer to show us the default notices that had been issued before the listing. Any creditor that lists a default has to be able to produce them.

Why it came off

Lion Finance couldn’t get copies of the default notices from the original energy retailer. Without them, it couldn’t support the listing and agreed to remove it.

The result

We started on 20 February. The default came off on 21 March, 29 days later. Rebecca and her husband could go ahead with finance.

What this means for you

If you’ve been in a long dispute about payments being misapplied, don’t assume the default is final. Debt buyers often can’t get the original paperwork. Our credit repair lawyers ask for it straight away.
