Josh tried to pay. That’s what makes this one so annoying.

While he was renting, his energy provider simply didn’t send him a bill. He called them. Then he called again. It took five calls and 14 months before a bill finally turned up. Not long after, the account was overdue and a default for around $640 landed on his credit file.

Diagram of how this case was resolved: no bill for 14 months, process not followed, default rules breached, removed in 1 day

What it was doing to him

Josh needed finance. His broker knew that even a small energy default can be enough for a lender to say no, and called us to refer him.

What we found

Before a creditor can list a default, it has to follow a set process. That means sending bills, then giving proper written notice that the account is overdue and could be reported. You can’t skip steps, and you can’t create an overdue debt by failing to bill someone for over a year.

In Josh’s case, that process clearly hadn’t been followed.

Why it came off

When we put this to the energy company, it agreed to remove the listing because the default process had not been followed correctly.

The result

We started work on 9 February. The default was gone on 10 February, 1 day later. Josh could go ahead and apply for finance.

What this means for you

Utility defaults are some of the most common we see, and some of the most fixable. Billing delays, accounts left open after a move and missing notices all come up again and again. If you’ve got one on your file, our credit repair lawyers can check whether the provider followed the rules.

Results depend on individual circumstances. Every credit file is different, and a past result doesn’t guarantee the outcome of your matter. This case study is general information, not legal advice.
