Credit Repair Background:
John* had instructed MyCRA Lawyers that he had a credit card account with Westpac. After the 2011 floods, he had an arrangement with Westpac under hardship. After 2 years, John* advised Westpac that their arrangement was too difficult to pay. He sent Westpac a payment offer to settle by registered post and ask if they didn’t accept the offer to contact him, and no response was received. John* understood this as Westpac’s acceptance. He was not aware Westpac did not accept his settlement offer and sold the debt to Lion Finance. At the time of the default, he had not recovered financially.
