Most removable defaults we see failed on process, not on whether money was owed. Australian credit reporting and consumer credit law put notice duties on creditors before a default can sit cleanly on Equifax or Experian. If those notices missing, late, or sent to the wrong place, you may have a correction pathway.

Two notice systems people confuse

National Credit Code default notices: for many regulated consumer credit contracts. These notices warn that you are in default under the credit contract and set out cure options.

Privacy Act / Credit Reporting Code notices: before listing consumer default information with a credit reporting body, providers generally need prior notice and timing steps (including the familiar 14-day style requirements discussed in OAIC and industry guidance). Amount and overdue thresholds also matter for ordinary consumer defaults (commonly at least $150 and 60 days overdue, confirm against the current Code for your listing date). Even a real debt can carry a flawed listing, as we explain in how to remove a genuine default.

A creditor can get one system right and still botch the other. Lenders and collectors do it more often than they admit. Start with how to get your free credit report if you don’t have both PDFs yet.

Plain-English checklist

  • Was the debt the kind that needs a Code default notice?
  • Did you receive a written notice at the address the creditor should have used?
  • Did the notice state the right account, amount, and what you had to do?
  • Were Privacy Act prior-notice and waiting periods observed before the bureau listing?
  • Were you actually 60+ days overdue for a consumer default listing?
  • Was the listed amount at least the consumer default threshold?

Keep envelopes. Returned-to-sender stickers matter. So do change-of-address emails you sent that nobody updated.

Wrong address is still a live issue

Australians move. Creditors sometimes keep mailing an old rental. If notices never reached you because the provider ignored a known new address, that can undermine a listing. Pull both free bureau reports every three months and compare the listed address history to your real timeline.

What to do if notices look wrong

  1. Get Equifax and Experian PDFs
  2. Write to the credit provider with a dated chronology
  3. Ask for copies of every notice they rely on
  4. Dispute through the bureau process where required
  5. Escalate to AFCA (if a member) or seek advice

Paying the debt is not the same as curing notice failure

Settlement can help lending optics. It does not rewrite history about whether the Privacy Act steps were followed. That is why “just pay it and it will disappear” is still one of the most expensive myths in Credit Prison.

Notice audit worksheet

For each default on Equifax and Experian, record: creditor, amount, list date, paid status, addresses on file, notices you received, notices the creditor claims, hardship emails, and whether you were 60+ days overdue. Gaps in that worksheet are where disputes live.

Wrong-address files need a separate address chronology (utility bills, mail redirection, licence, emails to the creditor). See wrong address defaults.

National Credit Code default notices and Privacy Act / CR Code prior-notice steps are different systems. Creditors can pass one and fail the other.

Equifax and Experian: always both

Australia’s consumer credit reporting bodies are Equifax and Experian. Experian absorbed illion’s consumer bureau from 1 April 2026, so you do not need a separate illion report today. Scores rarely match. Free consumer reports are available every three months (OAIC). After a refusal, ask about free access tied to that decision. Save PDFs, not only score dials.

A simple cleanup order

  1. Identity and contact data
  2. Defaults and serious credit infringements
  3. Judgments
  4. Enquiries
  5. Repayment history information
  6. Hardship flags

Dispute clear errors before you generate new hard enquiries. For broker deals, pause lodgement until the triage is honest. Use app.fixmybadcredit.com.au for a free file analysis once you have the PDFs.

Putting it into practice this month

Start with both free Equifax and Experian consumer credit reports. Under OAIC guidance you can access a free consumer credit report from each credit reporting body once every three months, and you should also ask about free access after a credit refusal or after a correction. Save the PDFs. Compare identity details, defaults, serious credit infringements, judgments, enquiries and repayment history information side by side.

Next, write a dated chronology for anything that looks wrong: notices received or not received, hardship emails, payments, address changes, and collector contact. Send a clear written dispute to the credit provider that disclosed the information, attach your evidence, and diary the response timeframes under the Privacy (Credit Reporting) Code. Use the bureau dispute process where required. If the firm is an AFCA member and internal dispute resolution fails, AFCA is free for eligible consumers. OAIC pathways may fit some credit reporting privacy complaints. The National Debt Helpline on 1800 007 007 remains available for budgeting and hardship conversations. If a broker deadline is close, a judgment or clearout is involved, or the creditor contests the facts, get a legal triage rather than spraying new hard enquiries across lenders. Reach us through our contact form, call 1300 667 218, or book a 15-minute intro call. Read the full framework on our credit repair lawyers Australia cornerstone. On consumer defaults accepted after initial assessment, our success rate is 91.6%, independently audited by a chartered accountant. Our own records show 29.4% of defaults are removed within 7 days. Fixed fees in writing. From time to time we run a Money Back Guarantee offer on listings with certain creditors. Which creditors it covers changes, so ask us if one is running.
