Madeleine lived in the ACT in a share house with a number of tenants. Madeleine was a full time student at University. The bills were in her name as it seemed easier than putting all the tenants’ names on the bill and she was the tenant who organized payment of the bills. Issued raised in MyCRA Lawyers’ complaint were: no credit guide provided by Baycorp (s 160 NCCPA), breach of general conduct requirement (s 47 NCCPA), no statement of amount owing (s 36 NCC), no copy of contract (s 20 & 185 NCC), no s 88 NCC. This started negotiations regarding a resolution. Baycorp then agreed to remove the default and presented Jason with a proposed repayment arrangement.

Credit Repair Background:
Unemployed at the time of the default, Cheng was struggling to provide for his family. He was made aware of the default through his broker when he went for a home loan. Credit Repair Background:
Matilda was at all times in direct negotiations with Simply Energy and Probe regarding a payment arrangement which they disturbed and failed to remedy. Credit Repair Background:
Amanda had 3 enquiries and 1 default listing on her credit file. The Optus default happened when she moved to Tumut and there was no service on her mobile phone. She contacted Optus and went to an Optus shop to explain that she had no reception in Tumut. Amanda went to the ombudsman to get out of the contract as they could not give her a sufficient service that she was paying for. Optus let her and her husband out of their contracts but her husband’s phone had a crack in the screen and they would not accept it so they had to pay $600. Instead, Amanda and her husband sent the phone away to get fixed with Optus, however; Optus never returned it thus Amanda and her husband never paid the amount owing due to not receiving the phone back and assuming the process was complete.

Credit Repair Background:
The default is from a labour hire company called MC Labour, and they defaulted Build & Co in July 2017. Build & Co had a client that owed them a large sum of money. The account they had with the client was 7 days however the monies were not paid for almost 3 months. No notices were received from the creditor and no notice received of the new creditor, Atradius, taking over the debt.

What were any challenges with the creditor?
