Credit Repair Background:
Bruriah has two default listings on her credit report. Bruriah was in between jobs and unable to make payments with Westpac. The debt was then handed to a debt collection agency. Due to pregnancy complications, Bruriah was unable to work and therefore unable to make payments. Despite this, the credit agency would not hold off payments and demanded full payment of the debt and she received letters twice a week in addition to the constant phone calls every week. Bruriah ended up having to change her phone number and ignore all her mail due to the harassing nature of the demands as Bruriah was already dealing with stress in real life with a baby and medical issues.
What were any challenges with the creditor?
ACM Group were adamant that the default was valid and they refused to remove the listing at the time of the investigation.
Why was the listing removed?
Westpac/ACM would not agree to remove the default. MyCRA Lawyers lodged a CIO complaint to prevent ACM from enforcing the debt. The debt became statute-barred on 01/06/2018 and Bruriah’s lawyer advised CIO of this. CIO said because listed as SCI, cannot be removed because of stat barring. Lodged correction request with CRB. CRB confirmed on 06/08/2018 that listing was removed.
Summary:
