    A survey conducted for the Attorney-General’s Department reveals Australian credit ratings are under increasing threat from ballooning identity theft numbers, and a consumer advocate for accurate credit reporting warns victims can pay heavily, with many locked out of mainstream credit for years.

    CEO of MyCRA Credit Rating Repair, Graham Doessel says when fraudsters take out credit in their victim’s name they can leave a trail of destruction on the victim’s credit file.

    “Fraudsters are never so kind as to pay the credit back. Defaults can then mount on the victim’s credit rating and hinder the victim’s ability to obtain credit in their own right,” Mr Doessel says.

    He goes on to say that “unless the victim can prove they didn’t initiate the credit in the first place, these defaults stay on the credit file for the term, which is five years.”

    The warnings come following the release of the ‘Identity Theft Concerns and Experiences‘ survey conducted by Di Marzio Research for the Attorney-General’s Department. (1)

    The survey found that identity theft had increased by a massive 40 per cent from 2011 to 2012 to almost one in four Australians having been a victim or known somebody who has been a victim of identity theft.

    It also showed 31 per cent of those victims had had their identity used to obtain finance, credit or a loan. This is an increase of 5 per cent from the previous survey in 2011.

    These figures correlate to almost one in every twelve Australians being victims of identity fraud which has had the potential to impact their credit rating.

    Mr Doessel says pieces of personal information are the building blocks for credit file misuse.

    “People can lose personal information in many ways, and they may be unaware of how or when it has occurred – particularly if it has happened via malware or even through too much sharing online,” he explains.

    “Sometimes it’s not until the victim applies for credit and is refused that they find out they have been exposed to identity fraud, and by then it may be too late to trace how it took place.”

    The survey pinpointed the private sector (Credit Providers such as banks and telcos) as providing victims with the most help with recovery, at 48 per cent – followed by Police at 32 per cent. Interestingly the government was cited as providing only 8 per cent of help with recovery, and 18 per cent of people had no help with recovery.

    But Mr Doessel warns that whilst Credit Providers may be able to help with reimbursing some identity theft victims, those that end up with defaults may not be so lucky.

    “It’s not a simple case of being ‘reimbursed’ for credit file misuse under the Credit Provider’s insurance. It is a slow and difficult process to try and recover a good name which has been tarnished,” he says.

    Mr Doessel says preventative measures centre around the safeguarding of personal information.

    “Get up to speed on the ways that fraudsters could misuse your personal information or your credit rating. Put as many preventative measures in place as possible, so that you have the least possible chance of becoming a victim.”

    “Also, check for credit file discrepancies. We recommend people regularly obtain a copy of their credit report to ensure that everything on their file is as it should be. That way if there are any problems, they can be rectified while there is no urgency,” he says.

    Under current legislation a credit file report can be obtained for free every 12 months from the major credit reporting agencies Veda Advantage, Dun and Bradstreet and TASCOL (if in Tasmania) and is sent to the owner of the credit file within 10 working days, or for a fee it can be sent urgently.

    Mr Doessel adds, Australia needs to create a culture of transparency when it comes to combatting this crime.

    “Talk, talk, and talk some more, about what you know about identity theft.  If you’re a victim – tell others about your story. In particular, talk to young people who might not fully understand the consequences of giving away their personal information and also talk to older people – who may be less tech-savvy and more vulnerable to predators,” he advises.

    A consumer advocate for accurate credit reporting hopes the introduction of a public scoring system from Veda Advantage will be the catalyst to boost dangerously low credit awareness and reduce the likelihood of credit disasters following the implementation of new Privacy Laws next year.

    Graham Doessel, CEO of credit repair company MyCRA says the Veda credit score is calculated from interpreted data at Australia’s biggest credit reporting agency, Veda Advantage – and has up till now been used by many lenders to assess credit worthiness.

    “This information is now available to consumers, and this is a positive step in terms of transparency,” Mr Doessel says.

    “But what I am most hoping will happen, is that more Australians will find this new number an easy and attractive starting point to finding out more about managing their own credit-worthiness.”

    He warns if we don’t facilitate credit-savviness now, possibly millions of Australians could be severely disadvantaged come March 2014 when new data sets are available on Australian credit reports.

    “The need for knowledge is going to be greater next year, as more people are going to get caught out with a bad credit score, and be scratching their heads to understand why,” he warns.

    Recently Veda Advantage released results of its analysis of 300,000 VedaScores with consumer research of 1,000 Australians, and found that an astounding 80% of people had never accessed their credit report.

    “…despite 15% of Australians being at risk of a credit default being recorded on their credit report in the next 12 months, considerable lack of awareness exists about what a credit history is, or how a poor credit report can impact chances of getting credit from lenders,” Belinda Diprose, Veda Marketing Manager says.

    Mr Doessel says it demonstrates an alarming rate of ignorance in the community.

    “It’s not really the fault of consumers. In my opinion there has not nearly been enough emphasis on public credit education right across the board up until quite recently,” he says.

    Mr Doessel says there are some important basics about their credit rating that Australians should know.

    5 Things You Need To Know To Manage Your Credit Worthiness.

    1.  You don’t have to pay to see your credit file, just your credit score.

    In most cases you can access your credit file for free annually from all of Australia’s credit reporting agencies, and this will remain at a standard 10-day issue from receipt of application. It is important to apply for your credit file with each credit reporting agency – as you may have defaults with only one company. They are: Veda Advantage, Dun & Bradstreet, Tasmanian Collection Services, and Experian.

    2. Your credit score rates you based on other credit-active Australians.

    Your credit score based on Veda data will be available to you when you pay to see your VedaScore with your credit report, via this particular credit reporting agency. Veda Advantage holds roughly 16.5 million Australian credit files – so the data should be quite predictive of your overall credit worthiness in comparison to other credit-active Australians. If you are applying for credit in the near future, this credit score could be important to know.

    3. There are several factors that make up your credit-worthiness.

    Items such as negative credit listings (defaults, Court Writs, Judgments and Bankruptcies); number of credit enquiries and the type and size of credit requested in your past application can all impact your credit worthiness.

    But there are other pieces of information about you which also have a bearing on your credit score – including your address; your age; how long you’ve lived at your current address; any business directorship or partnership you have, and the address of the business and length of time there.

    4. There will be more factors affecting your credit-worthiness next year.

    As of March 2014, there will be 5 new data sets available on Australian credit reports, and this data will be used in any credit score calculation.

    They are: repayment history information; the date on which a credit account was opened; the date on which a credit account was closed; the type of credit account opened; and the current limit of each open credit account.

    5. Late payments will impact your credit file.

    You will still be defaulted if you are more than 60 days late in making repayments to any Credit Provider, but in addition if you are more than 5 days late paying a licenced Credit Provider, you will be issued a late payment notation and this will show on your credit file from March 2014.

    Repayment history information applies to credit such as loans and credit cards and is being collected NOW. Too many late payments will more than likely reduce your credit score significantly.

    Mr Doessel says better credit education should eventually lead to fewer inconsistencies in credit reporting.

    “Credit rating errors are quite common, and the onus of ensuring the credit file is accurate rests with the consumer – so better education across the board could result in more errors being ironed out in the credit reporting systems,” he says.

    The decision by Veda Advantage to offer credit scores to Australian consumers previously reserved for lenders has been welcomed by a consumer advocate for accurate credit reporting – as long as Veda  clearly outlines how the score is calculated.

    CEO of MyCRA Credit Rating Repair, Graham Doessel says in general consumers have been kept in the dark about how to best actively manage their credit worthiness.

    “I believe every credit active individual has the right to know what their credit score is, but with that, they also need to know how that score is arrived at to positively manage their own credit decisions,” Mr Doessel says.

    He says people believe if they pay all of their bills on time, their credit score will be high, but this is not always the case.

    “There are a range of factors that go into the score calculation – and it has all been a bit of a mystery to consumers really which is not ideal,” he says.

    Mr Doessel says largely consumers don’t even know they have a credit score.

    “Most times it’s only when their credit score is lower than it should be to obtain finance with a lender that consumers even know they have been rated with a number attached to their approvability,” he says.

    Veda Advantage’s Marketing Manager Belinda Diprose told Banking Day yesterday there was a low level of consumer awareness about credit reporting, with as much as eighty per cent of people having never checked their credit report.[fusion_builder_container hundred_percent=”yes” overflow=”visible”][fusion_builder_row][fusion_builder_column type=”1_1″ background_position=”left top” background_color=”” border_size=”” border_color=”” border_style=”solid” spacing=”yes” background_image=”” background_repeat=”no-repeat” padding=”” margin_top=”0px” margin_bottom=”0px” class=”” id=”” animation_type=”” animation_speed=”0.3″ animation_direction=”left” hide_on_mobile=”no” center_content=”no” min_height=”none”][i]

    Mr Doessel says currently the big issue with allocating a credit score under the current credit reporting system, is that the number is only calculated on negative data.

    “It’s not balanced. An individual can have a few too many credit enquiries in a certain period, and perhaps apply for the ‘wrong’ type of credit, which will reduce their rating, and there is no consideration for paying bills on time to offset that information,” he says.

    New Privacy laws to take effect March 2014 will provide extra information for lenders and Mr Doessel says this will deliver a bigger picture of credit suitability and more information from which credit reporting agencies can draw on to calculate a fairer credit score.

    “Until then, any number of things could be shaving points off your score – consumers don’t really know for sure the full gamut of what may reduce it, and this needs to be made public knowledge now that the score is available and moving forward towards comprehensive credit reporting in March.”

    CEO of MyCRA Credit Rating Repair, Graham Doessel says many of his clients have been funnelled into the paid option for their credit report, without being given the option to wait and access it for free.

    “Most people we meet who have already got a copy of their credit report have paid for it. Overwhelmingly most people seem to not know they should be accessing it routinely nor that they have a right to access it for free annually,” Mr Doessel says.

    Consumers are entitled to access a copy of their credit report once per year free of charge with each credit reporting agency.

    Mr Doessel says people should routinely obtain a copy of their credit report if they are intending to access credit in the future, and that doing so will probably negate the need for an urgent copy due to finance refusal.

    “A credit report reflects what lenders will see when they do a credit check before lending people money, so individuals should ensure their credit history is accurate prior to a credit application. Bad credit history can impact credit worthiness for a considerable time,” he explains.

    He says the free credit report is the same document,with the difference being it is sent within 10 working days of receipt of the request.

    “Some people need their credit report urgently, and for this reason the paid service is quite necessary. But others are merely doing routine checks, and should not be duped into paying for their credit report if they don’t require it right away,” he says.

    He says that the free option should be in plain view on the bureau’s website as well as being explained as an option when individuals enquire via telephone about their credit report.

    Mr Doessel is calling for stronger guidelines in the new credit reporting laws around educating individuals about their rights to access their own credit information and how they can do it.

    “With all the new changes to credit reporting coming through, many Australians have been encouraged to check what’s said about them on their credit file. As credit reporting bureaus are in effect caretakers of that credit information, they should be obliged to educate individuals about their rights,” he argues.

    “There should be a stipulation that credit reporting bureaus must routinely offer all options available to individuals when accessing their credit report so they can decide for themselves whether they need their credit report urgently or whether they are able to wait the 10 days for it,” he says.

If you have ever taken out or applied for credit, you will have a ‘credit file’ in your name, and a consumer advocate for accurate credit reporting says the end of the financial year should be the time to include an all-important credit check to your financial repertoire.

    Graham Doessel, CEO of MyCRA Credit Rating Repair says obtaining a copy of your credit report regularly is an essential component to maintaining good financial records.

    “Most people don’t think about their credit file until they apply for credit, let alone the implications if they should find out they have a default or other negative listing against their name,” he says.

    Mr Doessel believes most people don’t know they should check their credit file, because they are largely unaware of the frequency of credit rating errors, or listings added unlawfully by Credit Providers to Australian credit files.

    “Unfortunately, paying all of your bills on time doesn’t always guarantee a clear credit file – there can be a number of go-wrongs including billing errors, unfair bills, address mix-ups and mistaken identities – and our growing client base is testament to this issue,” he says.

    Credit reporting agency Veda Advantage alone holds over 16 million credit files in Australia, but currently there are no official statistics on the number of Australians with ‘bad credit’ or negative listings – although in the past there have been reports of that figure being around 3 million. Likewise, there are no statistics for the number of credit listings disputed with individual Credit Providers.

    “This makes it difficult for individuals to get any scope for the likelihood that their credit file may contain errors,” Mr Doessel says.

    He says Australians should check their credit file at least once a year with all relevant credit reporting agencies, to make sure they have the all clear.

    “Although it is not well publicised, Australians can access a copy of their credit report every year for free from Australia’s credit reporting agencies,” he says.

    You can apply for a copy of your credit report from agencies Veda Advantage, Dun & Bradstreet, Experian and Tasmanian Collection Services (if in Tasmania). A free report will be sent within 10 working days, or you can pay to get an urgent report.

    Mr Doessel says the end of financial year is the best time to order a copy of your credit report – as your financial records tend to be in order if you have just completed a tax return.

    “This way, if there are any items you wish to cross-check on your credit file, you will have all the necessary information at your fingertips,” he says.

    If your report comes back with errors, or you feel a listing is unjust or shouldn’t be there, you do have the right to have incorrect information rectified.

    “Depending on the nature of the dispute, this may be fairly straightforward, or you may find that it requires the help of a third party advocate,” he says.

    Credit numbers are expected to decline when more data is reported about Australian credit habits in March next year, and a consumer advocate for accurate credit reporting warns, some simple mistakes may mean it is your credit worthiness on the line.

    CEO of MyCRA Credit Rating Repair, Graham Doessel says this is an important time to know about Australia’s credit laws, and to be careful with how you use and repay credit.

    “Australian consumers are currently under the microscope with their repayments, and if they are more than five days late with their repayments to licenced Credit Providers, that is going on their credit record now for two years and will show up as of March next year,” Mr Doessel advises.

    “In my opinion, this is going to trip up many Australians. With only a 5 day grace period proposed, it may mean many Australians are unnecessarily banned from credit due to simple billing mistakes, lost paperwork and other payment mishaps,” he says.

    The prediction of reduced credit numbers has been echoed by Dun & Bradstreet CEO, Steve Brown at a recent Australian Banking and Finance Conference.

    Publication Banking Day reported Mr Brown as telling the conference that a contraction in consumer credit will take place following the introduction of comprehensive reporting in March.

    “Lenders will start to learn things about consumers that they did not know before, such as the number of late payments they make,” Brown says.

    And so say Citigroup.

    “Citigroup Australia’s country risk director for consumer, CLN Murthy, agreed that there would be a tendency to reduce credit limits after comprehensive credit reporting came in,” Banking Day reports.

    Repayment information will be part of five new data sets to show up on your credit report as part of wide-sweeping amendments to Australia’s Privacy Act, which includes a new Credit Reporting Code of Conduct.

    “Prospective lenders will be privy to your repayment habits – and the word is out that more and more information may be on the table going forward,” Mr Doessel warns.

    Banking Day recently reported that Mr Brown and others in the consumer finance industry will be pushing for even more data to be included in the future.

    “Brown said Dun & Bradstreet would like to see the inclusion of account balance data in credit files,” Banking Day reports.

    The long term plans with respect to repayment history information is to be able to offset good repayment history against a default listing. The conference predicted that products and pricing structures could be developed for these borrowers.

    In the meantime, Mr Doessel says there are some simple things credit-active Australians can do to make sure their credit-worthiness remains in-tact:

    1. Pay on time, every time. Pay within five days of your bill’s due date to avoid a late payment notation. It doesn’t have to be a big amount to impact you. Too many late payment notations will probably mean you’re refused credit, or offered only a high interest rate.  

    2. If you can’t pay, actively seek help. There are new laws to help prevent you from being defaulted if you are under financial hardship, provided you get in early with your Credit Provider. So there is a new incentive to get in and work it out prior to letting your accounts go into arrears and copping a default listing.

    3. Seek cautions credit limits. If you’re not using it, don’t have it is the general adage. If you take out a credit card or other line of credit, it’s probably not wise to opt for a lofty limit, but ask for an amount closer to what you intend to use.

    4. Consider identity theft risks. Understand how lucrative your personal information is and take steps to keep abreast of how it can be at risk. New laws will allow you to place a ban period on your credit information if you believe you may be at risk of identity theft. Acting quickly may prevent credit file misuse.

    5. Check your credit file regularly. With the new information available, it will be more important than ever to check your credit file. Many people don’t know you can do this for free annually through the Australia’s credit reporting agencies and a copy is sent within 10 working days.

    6. Correct credit information which you believe is inaccurate, inconsistent or unfair. To offset the new information, new laws will make it fairer for those disadvantaged individuals to access and correct their credit report.

    But Mr Doessel says there will still be a requirement to work within and have knowledge of credit reporting law when disputing an inaccurate or unfair credit listing.

    “It is important to note, that Credit Providers and Ombudsman must act impartially and cannot advocate for you,” he warns.

    He says you can start by contacting your Credit Provider yourself to alter incorrect information, or you can put your case for dispute in the hands of an advocate.

    “You should take steps to rectify mistakes before the information has any bearing on a credit application you may make in the future,” Mr Doessel says.

    Millions of Australians could potentially be unfairly rated during the credit reporting process with little to no education on how their score is arrived at, nor any chance to redeem a bad credit score, a consumer advocate for accurate credit reporting reveals.

    CEO of MyCRA Credit Rating Repair says a recent scandal over consumers being blacklisted from taking out credit because of too many credit applications – often which they have little control over, reveals a gaping hole where legislation is yet to meet current practice.

    “Before we allow consumers to get a ‘scoring’ based on their assessed potential for risk then we need to make sure the information we are using to calculate that score is both fair and accurate, and in some instances under the current system it is neither,” Mr Doessel says.

    These comments come after it was revealed on Channel 7’s Today Tonight on Monday that 5-6 million Australians are in the ‘credit dog-house’ simply because they have applied for finance.[fusion_builder_container hundred_percent=”yes” overflow=”visible”][fusion_builder_row][fusion_builder_column type=”1_1″ background_position=”left top” background_color=”” border_size=”” border_color=”” border_style=”solid” spacing=”yes” background_image=”” background_repeat=”no-repeat” padding=”” margin_top=”0px” margin_bottom=”0px” class=”” id=”” animation_type=”” animation_speed=”0.3″ animation_direction=”left” hide_on_mobile=”no” center_content=”no” min_height=”none”][i]

    The report revealed that excess credit enquiries are having a major effect on borrowers, and most don’t even realise they have credit enquiries on their credit report until it’s too late.

    Mr Doessel says credit enquiries are not always due to being refused an official credit application.

    “Sometimes banks can perform enquiries periodically on lines of credit, and another big issue is system generated enquiries through consumers investigating different credit products online,” he says.

    He says whilst in most cases borrowers have technically given permission to perform the enquiry, there is little education on the ramifications of making one.

    “Information on credit applications made stays on a person’s credit file for 5 years. But how many credit enquiries is too many, and over what period of time?” he says.

    The Today Tonight report absolves credit reporting agencies such as Veda Advantage, saying they simply hold the records.

    “It’s the current legislation that only allows negative information to appear on our credit records and loan applications are listed as negative,” Veda Advantage’s Belinda Diprose advises.

    But Mr Doessel says scoring systems such as the Veda Credit Score is far from just reporting.

    “Issuing a credit score goes further, calculating risk based on certain types of behaviours around credit and allocating a score accordingly which is used by lenders to assess whether the potential borrower is a good or bad credit risk. That’s more than reporting, that’s opinion, that’s making predictions,” he says.

    Mr Doessel argues that credit scoring should not have been introduced prior to implementation of the Privacy Amendment (Enhancing Privacy Protection) Act 2012 in March 2014, which allows for more comprehensive data on Australian credit files.[ii]

    “This new form of credit assessment should not have been introduced until comprehensive credit data was available to lenders, not just negative data. To be fair to consumers, an educated ‘opinion’ on credit-worthiness needs to be formed based on many more factors than what is currently available on Australian credit reports,” he says.

    In the meantime, he is calling for education to give consumers clear guidelines as to what constitutes a low credit score.

    “Consumers need to know how this score is calculated, what sort of information will be taken into consideration when they are given a credit score, and what they can do to prevent a score being so low they are refused credit, both in the current market and when comprehensive credit reporting comes into effect next year,” Mr Doessel says.

    More of Australia’s new generation of first home buyers are living with credit defaults and a consumer advocate for accurate credit reporting says this could be a contributing factor in Australia’s dim first home buyer figures – with Gen Y facing credit lockdown in increasing numbers.

    According to a recent report from credit reporting agency Veda Advantage, the number of credit defaults amongst Gen Y has grown 5.3% over the past three years to 60% of the share of all credit defaults.

    Veda says Gen Y has the lion’s share of defaults across all account types – telecommunications, credit cards, utilities and personal loans. The biggest pain is telco bills – with Gen Y responsible for 62% of these kinds of defaults, compared to Baby Boomers (13%) and Gen X (22%).[fusion_builder_container hundred_percent=”yes” overflow=”visible”][fusion_builder_row][fusion_builder_column type=”1_1″ background_position=”left top” background_color=”” border_size=”” border_color=”” border_style=”solid” spacing=”yes” background_image=”” background_repeat=”no-repeat” padding=”” margin_top=”0px” margin_bottom=”0px” class=”” id=”” animation_type=”” animation_speed=”0.3″ animation_direction=”left” hide_on_mobile=”no” center_content=”no” min_height=”none”][i]

    Figures released yesterday by the Australian Bureau of Statistics confirm first home buyer commitments as a percentage of total owner occupied housing finance commitments fell to 14.9% in December 2012 from 15.8% in November 2012.[ii]

    “The older portion of Gen Y should be collectively entering the property market, but it seems more are suffering with 5 years of credit defaults and unable to even get a mobile phone plan let alone a home loan,” he says.

    Mr Doessel says education and advocacy is the key to helping Gen Y out of the credit crunch as he says they are only a product of the credit environment they were born into.

    “There is a real lack of education around credit issues and credit reporting and this has been a problem for some time. Many Gen Ys had credit thrown at them in their younger years pre -GFC and now they are feeling the ramifications of credit overload.”

    “On the back of this, has been a noted lack of consistency in credit reporting and this has led to a number of inaccurate and unfair credit defaults placed on consumer credit reports. It is high time that consumers and their advocates insist on accurate credit reporting if we are going to have any chance of moving the housing industry forward,” he says.

    The identities of thousands of Australian consumers could be at risk every day through simply having their personal information dumped into the rubbish bins of Australian businesses, and a consumer advocate for accurate credit reporting says this practice is an appalling oversight when personal information has become so valuable to fraudsters.

    The investigator went through the contents of publicly accessible waste bins used by 80 Sydney businesses that have an established responsibility to client data, with the aim of discovering the relative percentage of confidential waste that might be available on a given day.

    They found 11 per cent of those businesses contained crucial personal information readily accessible to passers-by and identity thieves.

    “Some sectors did better than others,” said NAID CEO Robert Johnson. “For instance, of the nine randomly sampled trash bins serving government offices, no confidential information was found. On the other hand, bank branches fared less well with 40 percent found to be casually discarding confidential financial information.”

    The study involved someone ‘casually’ looking at a bin, rather than dissecting it in an overly-thorough manner.

    CEO of MyCRA Credit Rating Repair, Graham Doessel says “dumpster diving”– a practice of looking through rubbish bins for personally identifiable information is well used amongst fraudsters – and unlike many other forms of attempted identity theft, can be easily prevented through careful destruction of personal information.

    “It is best practice in my organisation and I am sure in many others, to cross-shred every piece of personal information that is no longer required. If it is good enough for small business, it should be good enough for bigger business such as banks to properly dispose of this information,” he says.

    On Monday new Attorney-General, Mark Dreyfus QC warned that Australian businesses were increasingly being targeted for cyber-assaults.

    “Cyber attacks have shifted from being indiscriminate and random to being more coordinated and targeted for financial gain. Most attacks occur from outside the business, although it appears internal risks are also significant,” Mr Dreyfus said.[ii]

    Mr Doessel says whilst cyber crime is becoming increasingly prevalent, basic data destruction is still a pressing topic.

    “We can’t forget about educating Australian businesses on data destruction and this simple way they can prevent their clients’ personal information from being stolen by identity thieves,” he says.

    He says consumers should feel unnerved that it was so easy for the investigators to come across personal information in rubbish bins.

    “Pieces of personal information are basically the building blocks of identity theft. Crucial details such as full names, addresses and dates of birth can all be used to build a profile on the victim which can then be used to assume their identity and even take out credit in their name. Often victims don’t know about it right away – and that’s where their credit file can be compromised,” Mr Doessel says.

    He says once the victim’s credit rating is damaged due to defaults from this ‘stolen’ credit, they are facing some difficult times repairing their credit rating in order to get their life back on track.

    “These victims often can’t even get a mobile phone in their name. It need not be large-scale fraud to be a massive detriment to their financial future – defaults for as little as $100 will stop someone from getting a home loan for the five year term,” he says.

    He says what is not widely known is how difficult credit repair can be – even if the individual has been the victim of identity theft.

    “There is no certainty that defaults can be removed from a victim’s credit file. The onus is on them to prove their case and provide copious amounts of documentary evidence,” he says.

    The ramping up of efforts by fraudsters to go after Australian businesses holding personal information could contribute to a greater risk of identity theft and subsequent credit fraud for Australian consumers, warns a consumer advocate for accurate credit reporting.

    Yesterday new Attorney-General, Mark Dreyfus QC advised that recent national survey results for more than 250 major businesses show cyber-crime is becoming increasingly targeted and coordinated, with one in five businesses experiencing one in the last year.

    Mr Dreyfus said that cyber assaults have shifted from being indiscriminate and random to being more coordinated and targeted for financial gain.     The 2012 Cyber Crime and Security Survey Report commissioned by CERT Australia and conducted by the Centre for Internet Safety at the University of Canberra revealed that most serious assaults involved the use of malicious software, theft or breach of private information and denial-of-service.

    In one case, an organisation reported the theft of 15 years’ worth of critical business data.

    A third of instances involved the theft of notebooks, tablets or mobile devices.

    CEO of MyCRA Credit Rating Repair, Graham Doessel says Australians should feel concerned about where their personal information could be exposed to potential company data breaches, as personal information has become a valuable commodity used to commit identity theft and potentially ruin the victim’s credit rating and their financial future.

    “We can’t take lightly the possibility that any company that keeps data on its customers could be at risk of cyber-crime. Identity theft is becoming more prevalent, and personal information is lucrative for fraudsters,” Mr Doessel says.

    Last week the Australian Taxation Office (ATO) announced the identities of four tax agents were stolen and used to fraudulently obtain AUSkeys giving access to specialist tax agent online services.

    Whilst the ATO was able to contain the threat, and cancel the AUSkeys, it said in a statement to the media that doing business online has benefits, but also comes with risks.

    “People looking to commit identity fraud constantly look for ways to profit so it is critical to remain vigilant regarding your personal information and online security,” the ATO statement said.[ii]

    Mr Doessel says this instance is one of a long line of assaults on Australian businesses and government entities in recent years.

    “Unfortunately it seems everywhere people turn one entity or another has been hacked – and it seems everyone with a computer is at risk. It is still extremely scary the level of risk peoples’ personal information undergoes these days when it is stored online,” he says.

    Personal information in the wrong hands can lead not only to identity theft but credit fraud, which involves the use of the victim’s credit rating, which can have significant long term consequences.

    “Basically, a lot of identity fraud is committed by piecing together enough personal information from different sources in order for criminals to take out credit in the victim’s name. Often victims don’t know about it right away – and that’s where their credit file can be compromised,” he says.

    He says once the victim’s credit rating is damaged due to defaults from this ‘stolen’ credit, they are facing some difficult times repairing their credit rating in order to get their life back on track.

    “These victims often can’t even get a mobile phone in their name. It need not be large-scale fraud to be a massive detriment to their financial future – defaults for as little as $100 will stop someone from getting a home loan,” he says.

    Once an unpaid account goes to default stage, the account may be listed by the creditor as a default on a person’s credit file. Under current legislation, defaults remain on the credit file for a 5 year period.

    “What is not widely known is how difficult restoring a credit file can be – even if the individual has been the victim of identity theft, there is no assurance the defaults can be removed from their credit file. The onus is on the victim to prove their case and provide copious amounts of documentary evidence,” he says.

    Changes to the Privacy Act 1988 should help consumers collectively when businesses experience cyber-crime which leads to a data breach.[iii]

    From March 2014, increased powers of the Privacy Commissioner will force organisations that experience a breach to do something about it. Previously, the Commissioner could investigate and make recommendations as to what the organisation should do, but it had no way of requiring the organisation to take action.

    The Commissioner can also issue civil penalties to organisations that experience a breach and either fail to take reasonable steps to protect the information entrusted to them, or fail to adequately respond.

    Mr Doessel says consumers need to be insisting that the companies who hold their personal information have adequate tools to prevent a data breach, but he says despite this, the changing nature of cyber-crime means it can be difficult to keep up with the technology of fraudsters.

    “Despite our best efforts to keep our details safe, we don’t have control over the IT systems of the company which holds our information, so we have to place a lot of trust in them to stay one step ahead of fraudsters. With most organised crime gangs now placing identity theft on their repertoire, more damaging and more frequent assaults are probably imminent in the future,” Mr Doessel says.

    He says as a matter of routine, consumers should check their bank and credit card statements thoroughly when they come in, and should also order a copy of their credit report regularly – which would indicate if their credit file had been misused.

    Under current legislation a credit file report can be obtained at no cost every 12 months from the major credit reporting agencies Veda Advantage, Dun and Bradstreet and TASCOL (if in Tasmania) and is sent to the owner of the credit file within 10 working days.
