Credit Repair Background:
Christian had a credit card account with Westpac. He was paying the minimum monthly repayments and was unaware that the account was overdue until the debt collection agency contacted him for payment which he then made. Credit Repair Background:
Sean* lost his job in April 2014. He immediately went to GE to notify them and he was informed that he was covered by insurance. Sean* completed the relevant forms and the insurance paid the monthly installments.
When he obtained employment, Sean* agreed to return to paying his installments, but after 9 weeks at the company, he was dismissed. He then went back to GE and explained what had transpired. They informed him that the insurance could not continue to pay as he had not worked for a period of 12 weeks. Whilst Sean* continued looking for employment, Sean was under a huge amount of stress, and he advised GE of this. He advised GE that he could not pay until he found work. Financial Hardship was never offered to Sean*. In February 2015, Sean* started working again and he enlisted the help of Christians Against Poverty (CAP) to help him make arrangements to pay off his creditors. He could not manage dealing with the creditors and he was diagnosed with severe depression. CAP did suggest that he go bankrupt, but he wanted to pay off his debt. Prior to Sean* losing his jobs, he was 100% up to date with paying back the loan.

What were any challenges with the creditor?
There were no issues with the creditor as they responded to our Law Firm requests in a timely manner.

Why was the listing removed?
The default listing only advised that GE was the current creditor, however, MyCRA Lawyers was unaware that the debt has been assigned to Credit Corp. GE ascertained an error in the default listing and contacted Credit Corp for removal.

Credit Repair Background:

Nicole and her partner refinanced their loan whilst they had an ATO Debt and a bad credit rating which meant that their interest rate was over 10%. During the period April 2014 – April 2016, Nicole and her partner’s were required to enter into additional repayment arrangements that resulted in very large monthly repayments to creditors. One of which was Toyota finance. It was a very difficult 2 years for Nicole and her partner and they were struggling to make ends meet.

Nicole originally asked a “credit repair company” for help wherein after she paid for ‘the service‘ they simply (and incorrectly) informed Nicole that the default could not be removed. Nicole was not willing to accept this outcome, and spoke to MyCRA Lawyers for expert advice. Nicole was initially hesitant, however, she knew that putting her trust with MyCRA Lawyers would be her best option to learn exactly what she was facing when it came to her credit report.

What were any challenges with the creditor?

Initially Toyota Finance supplied documentation to our firm. When MyCRA Lawyers audited the supplied documents an issue was noted that raised concerns. Nicole had informed Toyota Finance of her financial hardship and it appeared thatToyota Finance did not assist her.

We raised our concerns with Toyota Finance directly and they simply referred our firm to their initial response.

As Toyota Finance’s initial response did not appear to address our hardship concerns and therefore did not answer our queries, Nicole instructed MyCRA Lawyers to escalate the complaint to the Financial Ombudsman Service.

During the investigation, further evidence came to light which added to our concern that the appropriate hardship provisions were not afforded to Nicole. This was brought to the attention of the Ombudsman, who ultimately agreed that Toyota Finance did not offer the appropriate hardship provisions to Nicole and that the default listing should be removed.

Why was the listing removed?

The listing was removed on the recommendation of the Financial Ombudsman Service after MyCRA Lawyers investigation uncovered that the default had been listed unlawfully and that Toyota Finance were holding fast and not willing to remove the default listing.

Summary:

Nicole and her partner were referred to our office by their mortgage broker. Nicole had a default on her credit report which she needed investigated as she felt it wasn’t fair that she’d done everything right but she was still defaulted. Nicole has thanked and congratulated MyCRA Lawyers as although it took longer than she would have liked, Nicole confirmed that the work provided by MyCRA Lawyers was substantial compared to the previous company that she had used and who had given up on her case as soon as the creditor said no. Stephan was making repayments but was also trying to contact the debt collection agency to settle the debt however they would not return his calls. The account was eventually paid in full after it was default listed.

What were any challenges with the creditor?
Onesteel provided the documents promptly. MyCRA Lawyers investigated the information by Onesteel and found multiple errors in the default listing process. When MyCRA Lawyers findings were brought to Onesteel’s attention, Onesteel failed to action the matter for several months despite multiple follow-up attempts and their repeated broken promises to respond.

Why was the listing removed?
We found that the matter was listed as a “Clearout” (Also known as a “Serious Credit Infringement” (SCI)). SCI’s are defined in the Privacy Act 1988 (Cth) as:

“(a) an act done by an individual that involves fraudulently obtaining consumer credit, or attempting fraudulently to obtain consumer credit; or
(b) an act done by an individual that involves fraudulently evading the individual’s obligations in relation to consumer credit, or attempting fraudulently to evade those obligations; or
(c) an act done by an individual if:
(i) a reasonable person would consider that the act indicates an intention, on the part of the individual, to no longer comply with the individual’s obligations in relation to consumer credit provided by a credit provider; and
(ii) the provider has, after taking such steps as are reasonable in the circumstances, been unable to contact the individual about the act; and
(iii) at least 6 months have passed since the provider last had contact with the individual.” (Post-2014)

As Stephan was making regular repayments towards the debt and was in constant contact with the debt collector while trying to reach a settlement, the account could not be considered a SCI.

MyCRA Lawyers also disputed the listed dollar amount of the Clearout placed on Stephen’s credit report. Because Stephan was making repayments, at the time of the Clearout listing being added to his credit file he was only $2228.37 overdue and not the $7728 that Onesteel alleged.

Summary:
Stephan engaged MyCRA Lawyers to investigate the validity of the Onesteel “Clearout” default listing on his credit file as he’d only just become aware of his right to challenge the validity of the listing. His company won a new contract which required the setting up of new supplier accounts. The unlawful credit file listing was impeding the setting up of those new accounts. MyCRA Lawyers successfully negotiated the removal of his bad credit default listing in 137 days (longer than usual due to delays caused by the creditor) and Stephan has been able to move on with his life knowing that he is no longer impaired by the incorrect listing. We requested additional information from Credit Corp regarding Telstra’s billing, which Telstra took several weeks to respond.

Why was the listing removed?
Our investigation of Telstra’s file indicated the invoices and notices were posted to Roy.

Roy had indicated that his monthly invoices were emailed to him. He was able to evidence this by providing MyCRA Lawyers with a copy of an email from Telstra with his final invoice. Interestingly, Roy had never received any of the prescribed default notices by email.

Before a creditor can default list a debtor, the default notices must be issued to the debtor’s last known address. As this default was listed after the changes to The Privacy Act 1988 (Cth), the last known address can include an email address, should the email be the debtor’s preferred method of contact.

Telstra initially stated that all the invoices and notices were posted to Roy’s residential address however, upon presentation of Roy’s final invoice email, the default was promptly removed.

Summary:
MyCRA Lawyers are successful in removing most default listings and in Roy’s case, this listing took a little longer but at just 66 days, now that all of Roy’s defaults have been removed, he can now confidently apply for their home loan. Michelle missed payments as her husband was not working as he had just started his own business. She was made redundant from her job and was fortunate find employment quickly as a contractor; however, she was soon out of employment again. Michelle was off work for a few weeks then found stable employment however, her salary dropped $3000 net per month. Michelle was finding it hard to make ends meet, borrowed money from family for basic household essentials. Michelle suffered for about 6 months with her hardship.

During this, Michelle made monthly repayments, and also made an arrangement which she continued, however one payment was 5 days late due to having to borrow money.

What were any challenges with the creditor?
Citibank provided documents however there were missing statements. Citibank also initially advised that the default was listed correctly and will not be removed.

Why was the listing removed?
The default was removed as a complaint was escalated as her hardship was not evaluated properly under section 72 of the National Credit Code in assessing whether or not Michelle was capable of making the arrangements requested by Citibank.

We also disputed that Citibank did not provide Michelle with a Notice of Decision on Changing Credit Contract as per section 72(4) of the National Credit Code, as no notice was provided to our firm.

Summary:
Michelle was referred to our office by her mortgage broker. She had 2 defaults on her credit file and wanted them removed as she is applying for a construction loan.
