We look at the ins and outs of bad credit mistakes and what you can do about them.

    What is a bad credit rating?

    ‘Bad credit’ in Australia is generally credit listings such as defaults, writs, Judgments or Bankruptcies recorded against your name on your credit file by a Credit Provider.

    Most of these listings can make it very difficult to obtain credit for 5 years for defaults and up to 7 years for bankruptcy. This can affect many major areas of your life such as buying a home, taking out personal loans for vehicles, business loans and in many cases even credit cards and mobile phone plans.

    Currently, most of the major banks are rejecting home loan applications where the credit history shows a default listing (an overdue account which has lapsed past 60 days). Many lenders are even rejecting loans for excess credit enquiries such as two in thirty days or six within the year.

    How common are bad credit mistakes?

    There are over 16.5 million credit files for ‘credit active’ people, held by the major credit reporting agencies in Australia; Equifax (Formerly Veda Advantage), Dun & Bradstreet, Tasmanian Collection Service. (16.5 million credit files are held by Equifax (Formerly Veda Advantage) alone).
    Unfortunately, there are no current statistics on the number of credit mistakes which occur on Australian credit files.

    But to give you some idea, in 2004 the Australian Consumer Association (now Choice) conducted a survey which revealed 34% of the credit files of the people surveyed possibly contained errors.

    Most people that query Credit Providers and credit reporting agencies about their bad credit – especially where there’s a default, are told that the listing can’t be removed but can be marked as ‘Paid’ if the account was settled.

    This is often not good enough if you need to use credit over the next 5 years (which is almost everyone nowadays).

    What sort of bad credit mistakes are disputable?

    You should know that any credit listing which you believe is inconsistent, unfair, or incorrect can, and should be disputed. Credit rating mistakes could be anything from the credit listing placed by your Credit Provider on the wrong credit file; to the basis of the credit listing being unfounded; to incorrect notices being provided to you; right through to system errors and incorrect spelling, to name a few examples.

    How do I repair my bad credit rating?

    One important aspect to disputing a credit listing in Australia (also known as credit repair) is to remember is that we usually only get one chance at clearing our credit file.

    Sometimes we can attempt to deal with Credit Providers to remove the credit rating default ourselves and can do more harm than good by not understanding the legislation. This is where a firm focused on credit law can help.

    What does a credit law firm do?

    Disputing (or repairing) a credit file involves reviewing documentation– including the credit file and all the circumstances surrounding the default, writ or Judgment.

    Then the credit repairer negotiates with the creditor who initiated the listing on your behalf to remove the default.
    This can also often involve lengthy requests and submissions of documentation until an agreement is reached by the creditor and the repairer to remove the offending black mark.

    What is my credit rating?

    Your credit rating is a file on your credit history and is collated by the major credit reporting agencies if you have ever been credit-active. Your credit rating is then checked by any financial institution or credit provider and is used to assess both the amount you are able to borrow and your ability to repay the loan.

    What does ‘credit active’ mean?

    Anyone that has borrowed money, or has established an account for services is credit active and will have a file in their name. This includes mobile phone plans, accounts with utility companies, rates accounts and of course loans of any kind.

    What is defined as a ‘bad’ credit rating?

    In broad terms, any credit defaults, court actions or writs, external administrations and bankruptcy are all recorded on your credit file and would be considered ‘bad’ credit history by most credit providers.

    In this current economic climate, basic defaults and even too many credit enquiries or applications for credit may be considered to be tarnishing your credit rating. Your repayment history may also be considered ‘bad’ credit if you have too many late payment notations against your name.

    How do I know if I have a bad credit rating?

    If you are unsure what is on your credit file, it would be worth taking the time to find out.

    There are three major credit reporting agencies in Australia: Equifax (Formerly Veda Advantage) – which holds the credit file of over 16 million Australians, Dun and Bradstreet and Tasmanian Collection Service.

    You can write to or email one of these agencies and request a copy of your file. If you are not in a hurry there is no charge to you but it will take 10 working days from application to receive this information.

    What is not realised by many people is how easy it is to have a default slapped on your credit file. If a bill of $150 is more than 60 days late (including rates, power, and mobile phone bills) then a credit provider has the right to notify you of their intention to record this default on your credit file. Even if the account is paid and noted on your file, this default usually remains on your record for 5 years.

    In addition to this, if you are more than 5 days late repaying your credit card or loan account – you may also have a late payment notation recorded against your name.

    We look at the three things you need to ask yourself right now, that you may not have considered, but which could stop you from getting your dream home.

    Good deposit? Check.

    Good income? Check

    Paid off most of your debts? Check

    Stable job? Check.

    Most people who answer ‘yes’ to all of the above questions would assume they’re ready to go for finance and would be any lender’s favourite customer.

    If this is you, and you are about to talk to your broker or bank branch about getting a mortgage, there are 3 important questions you need to ask yourself before you do…

    1. Have I… disputed a bill with my credit provider/moved/divorced or separated/forgotten a bill/or not received a bill I should have in the last 5 years?

    These are probably the most common reasons people end up with a bad credit rating which sees them refused a home loan. Answering yes to any of these questions may mean you are at risk of having impaired credit show up when a lender does a credit check on you.

    Your credit provider may have issued a default in your name. If you have moved or separated or due to credit provider error, you may or may not have been made aware of your credit listing. These “oversights” whether yours or theirs may not be easy to remove, and many times clients who request their removal are told by their credit provider they are never removed but can be marked as paid if you settle the account. Unfortunately a paid listing is just as detrimental to your home loan as an unpaid one.

    If you fall into the above categories, do yourself a favour and apply to see your credit report before you apply for a home loan (www.freecreditrating.com.au).

     2. Do I have a copy of my credit report?

    Even if you believe you are not at risk of bad credit, and you always pay bills on time, mistakes can and do happen. Don’t let the lender be the one to see them first, order your own credit report and make sure you have the all clear before you apply. If the lender does a credit check they will generate a “credit enquiry” on your file. If you have bad credit, the credit enquiry will only add to the crosses against your name. So it’s best to check your credit file yourself first, which you have the right to do for free annually without generating an enquiry against your name.

    You can order your credit report from Australia’s credit reporting agencies. A free credit report takes around 10 working days to be sent to you by mail. MyCRA Lawyers also offers a credit file analysis service, which includes a credit assessment and same-day copy of your credit file service.

     3. Have I paid my credit card or any loan late in the last 12 months?

    Hopefully you have checked your credit report and it has come back clear…BUT even still, there may be things you are doing right now which are harming your future credit file. If you have been late making repayments to finance providers on accounts such as credit cards or loans you have been monitored (since December 2012). While this information doesn’t show up on your credit file yet, it will from March due to new credit reporting laws which are set to be implemented then. It will stay on your credit file for 2 years.

    If you think you have paid a credit card late, or your personal loan or other finance, then you may be at risk of a late payment notation against your name. If you are a serial late payer, even by a week or so, you are probably at risk of this new type of ‘bad credit’.

    Too many may mean you are refused credit after March. If you think this is you, you may need to apply for that loan before March, and not wait, or potentially risk being refused credit, or being offered a higher interest rate.

    It’s unclear how lenders will look at these notations – how many late payment notations will be too many and mean you’re refused credit, so take heed, and make sure you stop paying your credit accounts late in the future to protect your credit file.

    Australians must put credit issues on their radar to ensure a bad credit rating is not the surprise they get this Christmas season, warns a consumer advocate for accurate credit reporting.

    Credit repair pioneer Graham Doessel, who is now Non-Legal Director of MyCRA Lawyers – a firm focusing on credit disputes, says too many Australians are kept in the dark about their credit file, but anyone who intends to borrow money in the next five years should make it their business to prevent simple accidents from hurting their credit rating.

    “I fear many people are unknowingly making mistakes with credit right now, which will see them locked out next year,” Mr Doessel says.

    Back in September, Credit reporting agency Veda Advantage published results of a survey showing that 80 per cent of Australians have never checked their credit history and 53 per cent were not aware that they could ask for a copy of their credit file.(1)

    Mr Doessel says these statistics are severely worrying and show too many consumers are unaware of how important their credit file can be for lenders making financial decisions.

    “There are no class lines, whether rich or poor if your credit file is ‘impaired’ by negative notations, your ability to obtain credit will be affected or the interest rate you are offered will be higher,” he says.

    “I would like to say it is always cut and dried – don’t pay, get bad credit but in reality it’s not that simple.”

    There are number of ways you can make mistakes and end up paying dearly for it. Over the Christmas period the risks can be higher.

    Mr Doessel covers the 5 major credit accidents at Christmas time:

     1. Accidental late payment.

    Right now, if you make a payment late on licenced credit (being loans, credit cards and other finance) – the information is being recorded. You may not intend to actually default on your loan – but Christmas can be a busy time where payments can get overlooked by a few days. Don’t let this happen to you. After March next year, late payment information will be available to lenders on your credit report and will stay there for 2 years. So don’t put off paying your credit card after Christmas pay on time every time to make sure your credit rating isn’t impacted.

    2. Accidental default.

    If you happen to unknowingly let any bill (including your phone bill or Energy account) slip into default – (more than 60 days overdue) a default listing will be recorded against your name. You may have the funds to pay, you may have simply overlooked the account – but your credit file will carry that default listing for 5 years – and most times you will be refused mainstream credit because of it. So if you plan to go away for Christmas, make a plan to ensure all of your bills are organised prior to leaving.

    3. Being careless with your personal information.

    Scammers are out in full force at Christmas, but often people are too busy to take care with their personal information. Credit cards are used more frequently and at a variety of locations; we’re being encouraged to sign up for free giveaways; we’re giving out more details online – but you must consider the risks to your credit rating. If fraudsters are able to access your personal details they have the key to your good credit rating. They can run up credit all over town. Often it’s not until victims apply for credit in their own right and are refused because of defaults that they realise their credit file has been misused.

    4. Not forwarding new information to old Creditors during moving and transfers.

    Christmas and New Year is a very common time for transfers and other work changes to occur that could see people moving interstate. A change of address is a very common reason bills go unnoticed – along with warning notices and the result is a bad credit rating that may not be detected until you actually apply for a home loan. Before you go, tie up all loose ends at your current address, ensuring all changes of address and accounts are settled and confirmed in writing to avoid being blacklisted for credit.

    5. Overlooking errors and omissions from Creditors.

    Even creditors are affected by the silly season -with staff busy and preoccupied. The volume of transactions may increase while staff decrease, putting stress on the Creditors’ systems. For this reason it is crucial for you to keep watch on your own finances. Check your bank statements and bills at this time. Keep abreast of which bills are due and when. If you don’t receive a bill, chase it up. Busy people make mistakes – don’t let them make it with your credit rating.

    How to cure Christmas credit hangover

    There are not quick fixes for a festive debt blowout.

    OK, DESPITE the good intentions, the spending urge somehow got the better of you and you’ve blown the Christmas budget. Christmas credit card bills and bank statements are about to arrive, so how do you cure a seasonal debt hangover?

    Unfortunately, there’s no gain without pain when it comes to getting back in the black. Here are the top tips from debt and finance experts for easing that pain in the purse.

    The debt collector Credit reporting agency and debt collector Dun & Bradstreet says the worst thing anyone suffering a new year debt hangover can do is ignore the problem.

    “We often see a spike in defaults in the first half of the year, which results from credit used over the Christmas period,” Dun & Bradstreet chief executive Gareth Jones says.

    “Apart from causing financial pain, this situation can also impact people’s ability to access future credit as the default stays on a credit report for up to five years.”

    His top tips are:

    Close any bank accounts or credit facilities that are not essential.

    Don’t ignore letters or phone calls about debts. If you owe money, the best thing you can do is repay it.

    Pay attention to all your bills and pay them in full and on time.

    Avoid borrowing money to get out of one debt, and don’t use one credit facility to pay off another.

    The credit file manager Credit file advocate and repair service MyCRA says at this time of year fraud and identity theft is also higher.

    “The increase in credit usage in general can also mean issues like identity theft, financial hardship and basic credit reporting mistakes can be more prevalent at this time,” MyCRA chief executive Graham Doessel says.

    “An important part of curing a post-Christmas credit hangover is to take stock of what is said about you on your credit report. There is the potential for errors to be present on your credit report. Mistakes can and do happen but the responsibility for checking your credit file rests with you.

    “Most people don’t realise how easy it is to obtain a default. If any credit account has been left unpaid for greater than 60 days, the creditor can list the overdue account as a default on your file.

    “Often we see people in the new year who have missed paying a phone bill during the Christmas rush, then gone on holiday for some time, apply for a loan in the new year and are shocked to find they have a bad credit rating.”

    Doessel says now is the time to check your credit file.

    You can receive a free copy from most credit reporting agencies within 10 days or you can pay a fee to receive it sooner.

    If you have negative listings, defaults, writs or judgments, which you believe are errors or unfair, you have the right to have these entries rectified.

    Advisers and counsellors Financial advisers and counsellors say the first and best thing to do if you are in financial strife is to seek support.

    “Act quickly and ask for help,” says Financial Counselling Australia member Brian Harvey. “Speak to a financial counsellor, family, partner, your bank.

    “If people are left with post-Christmas debt, they should contact their providers as soon as possible to let them know they are having difficulties. They can then set up an affordable repayment arrangement, which will involve them first working out what is affordable. Often people put off dealing with the debt as long as possible, during which time it often grows.”

    Hewison Wealth adviser Glenn Fairbairn says sometimes refinancing your credit card by seeking a lower-cost loan can ease the repayment burden, or allow you to get ahead because you’re paying less interest.

    “It is important to prioritise the repayment of any outstanding credit card debt, even if this means cutting back on discretionary spending. Cut up your credit card. This will ensure that you don’t do the same thing again next year.

    “And start planning for next Christmas now.”

    The legal centre “Get on the front foot and seek assistance,” Consumer Action Law Centre spokesman Daniel Simpson says.

    “If you put off getting help, you’re only going to fall further behind.”

    “The first thing you should do is pick up the phone, call the credit provider.

    “Think twice before hiring a credit repair or budgeting service to help you. These companies make it sound easy and pain-free to repay your debts but they usually charge a significant fee.”

    If you’re in credit strife

    * Don’t ignore the problem. Be proactive and ask for help.

    * Act quickly and let your creditors know you are having trouble. Ask for a new repayment plan if you need to.

    * Start to repay a little, even $10, over and above the minimum repayments.

    * Set a strict budget, including all your repayments and bills before other spending.

    * Cut up all your credit cards.

    * See a free financial counsellor, phone 1800 007 007 for an appointment.

    * Be aware that budgeting companies and credit repair agencies charge a fee.

    The message to not bury your head in the sand, and to get on top of your debts early, can’t be stressed enough to avoid getting into hot water with defaults on your credit rating.

    However, it is important to know that credit repair and budgeting services are different entitites, and do different things for you. Credit repair is generally not a budgeting service.

    What is credit repair?

    A decent credit repairer addresses credit rating inconsistencies by auditing your credit file and customer information to find areas of non-compliance by your creditor which may see your default or other negative credit listing removed from your credit file. It is useful for those people who believe their listing is unfair, contains errors or is unfounded (or those people who want to check the lawfulness of their credit listing).

    You may dispute inconsistencies on your credit file yourself, and this is free. But many people choose to use a professional credit repairer to work on their behalf because they don’t have the time, and most importantly because they find the process incredibly difficult. To ensure successful removing of a credit listing from your credit file, you must prove that your creditor did not comply with the law when placing the default or other listing on your credit file.

    So its more involved than just showing right and wrong, it has to be demonstrated according to the law. We liken it a little bit to defending yourself in Court. Sure – you may be able to defend yourself, but your case has much more chance of success if you use a legal professional.

    An advocate for accurate credit reporting warns every credit-active Australian should make sure they’re not getting bad credit for Christmas, as surprise bad credit can happen to anyone, even those who pay all their bills on time.

    CEO of MyCRA Credit Rating Repair, Graham Doessel says it is important for Australians to understand how easy it is to wind up with a bad credit rating and not know it.

    “There are no class lines, whether rich or poor if you have taken out credit then you could be at risk. I would like to say it is always cut and dried – don’t pay, get bad credit but in reality it’s not that simple. The only way to be sure is to check your credit file regularly,” he says.

    A default listing can be placed on a consumer credit file if a bill payment is late more than 60 days.

    But Mr Doessel says there are many reasons why a consumer can be defaulted other than simply choosing not to make bill payments on time.

    “Creditors don’t always comply with the law, and sometimes they make mistakes – wrong names, wrong addresses, as well as human and computer errors,” he says.

    He also says certain circumstances can leave consumers more vulnerable.

    “Identity theft, separation from your spouse, bill disputes, overseas trips and even moving house would definitely be situations where afterwards I would be checking my credit file to make sure it was clear,” he says.

    Mr Doessel says unfair credit listings should be disputed, as negative listings such as defaults will mean credit refusal or higher interest rates for the term of the listing.

    He says listings are not removed by creditors unless the credit file holder or a third party acting on their behalf can provide adequate reason and lots of evidence as to why the listing shouldn’t be there.

    “It’s not easy to dispute a credit listing – but it is a point worth fighting for,” he says.

    Consumers are entitled to obtain a free copy of their credit report from Australia’s credit reporting agencies once per year. This is sent within 10 working days of the request.

    “If you have some time off soon, this might be a great time to do your credit file check. If there is something amiss on your credit report, you can dispute it with your Creditor yourself or you can contact a professional credit repairer to do it for you,” Mr Doessel says.

  • Debt stress: how to avoid it at Christmas time and dodge a bad credit rating

    What does it take to keep your head above water at Christmas time? A recent survey shows that the average Australian spends around $1,000 at Christmas, which is more than they can afford. And so they turn to credit. We look at the ramifications of letting credit pull you under at Christmas and holiday time, and look at recommendations for having a happy stress-free, debt-free Christmas and a clear credit rating in the New Year.

    This year more than ever, there seems to be a backlash in reliance on credit. Perhaps it’s that collectively Australians have been reducing their debt levels and trying to save money instead of spend it. So why is Christmas so different? Is it where we remove all of our previously frugal thoughts and blow the budget just to make the ones we love ‘happy?’ According to a recent news story – this seems to be the case.

    Yesterday Australian Broker featured an article ‘How to avoid a post-Christmas financial hangover’ and there were some interesting statistics about Australia’s Christmas debt numbers.

    Suncorp head of advice, Stephen Daly, told Australian Broker that over the festive season many consumers will turn to credit to fund Christmas celebrations despite saying they can’t afford the splurge:

    • 40% of 35 to 49 year olds will use credit to cover expenses they couldn’t otherwise afford, even though 60% of them feel stressed over their financial situation;

    • 25% of 50 to 64 year olds will use credit to cover expenses, even though 60% of them feel worried about their financial situation.

    But Daly says it doesn’t have to be this way. He says there are three major things consumers can do to prevent post-Christmas financial regret:

    1. Set a realistic budget within your financial means, and stick to it;

    2. Plan ahead for gift purchases – leaving gift buying to the last minute can lead to spending too much in a state of panic.

    3. Think about gift buying in the categories of what your loved ones “want”, “need” and “a little luxury” – that way you approach the task of gift-buying in a more considered way.

    “These simple tips can mean the difference between blowing out your budget in December, and paying it off over years in high interest, or removing the debt-stress.”

    Also, Daly says, it might be a good idea for Australians to re-think Christmas as a special time of year to spend quality time with loved ones, rather than being measured by the amount spent on presents.

    “It might seem like a great idea to give your loved one the iPad they’ve always wanted, but if you can’t afford it, the stress of the debt isn’t worth it. Our planners see people in January and debt can often be a cause of unnecessary stress when families over-extend themselves in December.”

    This unnecessary stress can lead to accounts in arrears, and all of a sudden the New Year can be looking pretty grim, with defaults on your credit file that could not only ruin next Christmas, but the next several.

    Defaults showing on your credit history can stop you from getting credit with most mainstream lenders, and a default will stay there for 5 years – so it’s important to avoid this at all costs.

    On November 1, we urged everyone to ‘get organised’ for Christmas  to save money and their credit rating – but life happens sometimes and you could be only now thinking about presents.

    So at this stage – it is important to stay firm if you don’t want credit to get away from you at Christmas. Here’s our Christmas budget tips:

    1. Write a budget. Only got $500 to spend this year? Then budget for that. With a little forethought you might be surprised at how well you can make your money stretch.

    2. Write a Christmas list – decide who to buy for, what to buy, where you will buy it from and how much you will spend (Christmas catalogues can be good for this).

    3. Don’t deviate from your original plan! Don’t be swayed by fancy lights and ‘bargains’ at the shopping centres – try to get in, stick to the list, and get out while you still have your sanity and your money in your wallet!

    4. Consider some handmade gifts or bulk gifts such as charity donations on your loved ones behalf as ways of keeping your budget down.

    And…..5. It’s not too late to suggest a ‘secret Santa’!

    Also, if you are having time off over the Christmas/January period, diarise to make a day to sort out your finances and include sending away for a free copy of your credit report in this list. Don’t let all of your hard savings work go down the drain because you have errors on your credit file that you don’t know about until you apply for finance.     While schoolies across Australia are celebrating finishing twelve years of education and looking forward to a bright future of bigger and better things, a consumer advocate for accurate credit reporting says when the good times are over, school leavers should prepare themselves for their new financial life as young adults.

    CEO of MyCRA Credit Rating Repairs, Graham Doessel says many young people amble through their early years with credit, making mistake after mistake that can cost them dearly down the track.

    “Young people can often get into a really bad pattern with credit, taking out credit cards, putting cars and electrical goods on credit and getting behind in repayments which sees them taking out new credit just to pay off the old credit.”

    “Before they know it, they’re 20 years old and facing bankruptcy or Court Action and years of being locked out of the finance market coming into the crucial years when they need it most,” Mr Doessel says.

    He says young people have got to be wise and ensure they are making credit work for them.

    He provides some advice for those young people coming of financial age:

    5 Important Credit Lessons For School Leavers

    1. Your credit file follows you…everywhere in Australia.

    Once you turn 18, you can become credit active, and can take out credit in your name. The history of your credit activity, good and bad is detailed on your credit file, which can be accessed by those thinking of lending you money.

    Your credit file lists personal details like name and address, but also any times you have applied for credit, any defaults (overdue accounts), court judgements, writs and bankruptcies.

    This credit file stays with you for life, and is added to by Creditors over your life.

    2. Overdue accounts are considered bad credit history.

    Many young people don’t realise how easy it can be to end up with a bad credit rating. Any account which is 60 days overdue (this ranges from mobile phones to credit and store cards, car loans to mortgages), is then considered in default. The Creditor then has the right to list this default on your credit file.

    “Even too many credit enquiries can show negatively on your credit report – so don’t apply with too many lenders – by all means do your homework but don’t sign up or give over your details until you’re sure you want the credit,” he says.

    3. Bad credit history matters.

    A single default for as little as $100 can stop you from getting mainstream credit in the current market for the term of the listing – which is five years.

    You may be forced to pay a whole lot more in interest to secure credit because of the risk of lending to someone with a bad credit rating.

    “Endeavour to pay all of your accounts on time. If you can’t pay, then contact your Creditor to work something out. You have to think ahead about what you want to achieve in another five years and whether the choices you make now could hinder those future plans,” Mr Doessel says.

    4. With all financial dealings, and especially credit – cover yourself at all times

    If you’re dealing with a Creditor in a tough situation, get the name of the person you’re dealing with, write down what is said and if a resolution is reached – get it confirmed in writing.

    If you need to cancel an account, don’t assume its cancelled until you receive written confirmation. If you are moving, provide a forwarding address.

    “This can be a common reason people get bad credit when they move – they may cancel a phone or electricity account and be left with a bill they weren’t aware of,” he says.

    Protect your credit file from misuse by keeping your personal information closely guarded. Your personal information is the key to your financial identity.

    “At all times – online, while making purchases, while banking, you need to be aware of the ways your identity could be compromised. You may not have a lot of money in your accounts – but you may have access to credit – and crooks can open accounts in your name and leave you with debts you can’t afford and your financial future ruined,” Mr Doessel says.

    5. You are responsible for the accuracy of your credit file

    Creditors can and do make mistakes with credit files all the time, but the responsibility to ensure your credit file reads accurately rests with you. Make it a habit to check your credit file once every year. This is free to do annually. All you do is contact the credit reporting agencies Veda Advantage (www.vedaadvantage.com.au), Dun & Bradstreet (ww.dnb.com.au) and Tasmania’s TASCOL (www.tascol.com.au).

    They will mail you a report within 10 working days.

    If you believe there has been a mistake on your credit file, then you have the right to have the mistake rectified. This may not be easy, but it is a point worth fighting for.
