    Stephan was making repayments but was also trying to contact the debt collection agency to settle the debt however they would not return his calls. The account was eventually paid in full after it was default listed.

    What were any challenges with the creditor?
    Onesteel provided the documents promptly. MyCRA Lawyers investigated the information by Onesteel and found multiple errors in the default listing process. When MyCRA Lawyers findings were brought to Onesteel’s attention, Onesteel failed to action the matter for several months despite multiple follow-up attempts and their repeated broken promises to respond.

    Why was the listing removed?
    We found that the matter was listed as a “Clearout” (Also known as a “Serious Credit Infringement” (SCI)). SCI’s are defined in the Privacy Act 1988 (Cth) as:

    “(a) an act done by an individual that involves fraudulently obtaining consumer credit, or attempting fraudulently to obtain consumer credit; or
    (b) an act done by an individual that involves fraudulently evading the individual’s obligations in relation to consumer credit, or attempting fraudulently to evade those obligations; or
    (c) an act done by an individual if:
    (i) a reasonable person would consider that the act indicates an intention, on the part of the individual, to no longer comply with the individual’s obligations in relation to consumer credit provided by a credit provider; and
    (ii) the provider has, after taking such steps as are reasonable in the circumstances, been unable to contact the individual about the act; and
    (iii) at least 6 months have passed since the provider last had contact with the individual.” (Post-2014)

    As Stephan was making regular repayments towards the debt and was in constant contact with the debt collector while trying to reach a settlement, the account could not be considered a SCI.

    MyCRA Lawyers also disputed the listed dollar amount of the Clearout placed on Stephen’s credit report. Because Stephan was making repayments, at the time of the Clearout listing being added to his credit file he was only $2228.37 overdue and not the $7728 that Onesteel alleged.

    Summary:
    Stephan engaged MyCRA Lawyers to investigate the validity of the Onesteel “Clearout” default listing on his credit file as he’d only just become aware of his right to challenge the validity of the listing.  His company won a new contract which required the setting up of new supplier accounts. The unlawful credit file listing was impeding the setting up of those new accounts. MyCRA Lawyers successfully negotiated the removal of his bad credit default listing in 137 days (longer than usual due to delays caused by the creditor) and Stephan has been able to move on with his life knowing that he is no longer impaired by the incorrect listing.     We requested additional information from Credit Corp regarding Telstra’s billing, which Telstra took several weeks to respond.

    Why was the listing removed?
    Our investigation of Telstra’s file indicated the invoices and notices were posted to Roy.

    Roy had indicated that his monthly invoices were emailed to him.  He was able to evidence this by providing MyCRA Lawyers with a copy of an email from Telstra with his final invoice. Interestingly, Roy had never received any of the prescribed default notices by email.

    Before a creditor can default list a debtor, the default notices must be issued to the debtor’s last known address. As this default was listed after the changes to The Privacy Act 1988 (Cth), the last known address can include an email address, should the email be the debtor’s preferred method of contact.

    Telstra initially stated that all the invoices and notices were posted to Roy’s residential address however, upon presentation of Roy’s final invoice email, the default was promptly removed.

    Summary:
    MyCRA Lawyers are successful in removing most default listings and in Roy’s case, this listing took a little longer but at just 66 days, now that all of Roy’s defaults have been removed, he can now confidently apply for their home loan.     Citibank provided documents however there were missing statements. Citibank also initially advised that the default was listed correctly and will not be removed.

    Why was the listing removed?
    The default was removed as a complaint was escalated as her hardship was not evaluated properly under section 72 of the National Credit Code in assessing whether or not Michelle was capable of making the arrangements requested by Citibank.

    We also disputed that Citibank did not provide Michelle with a Notice of Decision on Changing Credit Contract as per section 72(4) of the National Credit Code, as no notice was provided to our firm.

    The commercial default was listed as Rebecca was guarantor on the loan for her then husband and his business. When their relationship came to an end, her ex-husband retained possession and control of the motor vehicle.

    Rebecca first discovered the listing when she applied for finance.

    What were any challenges with the creditor?
    The only issues we had with this matter was in contacting St George.   The case manager was almost always ‘unavailable’.

    Why was the listing removed?
    We asserted that St George failed to provide sufficient default notices to Rebecca and that as no notice advised of St George’s intention to default list.

    St George believed that they were not required to issue a default notice as the account was commercial and refused to remove the default despite the evidence presented to them by MyCRA Lawyers.

    A detailed complaint containing our findings was drafted and escalated to the Financial Ombudsman Service (FOS). Agreement was reached and the St George Commercial Default was subsequently removed.

    What were any challenges with the creditor?
    CS Storage believed they didn’t have access to Veda Advantage, nor did they agree with the non-compliance issues raised.  The matter was referred for further investigation.

    Why was the listing removed?
    When our paralegal’s investigated Mark’s matter, we disputed the validity of the default listing as the account was listed as a commercial listing, however the storage was used exclusively for consumer purposes.

    We further disputed the contract Mark signed as it provided no clause allowing CS Storage the right to access Mark’s credit report.

    We also questioned why, when the account fell into arrears in October 2009, it took almost 5 years before Mark was default listed. Had Mark been listed correctly, the default would have been due to automatically expire.

    CS Storage responded by denying all allegations and further stated that they have no access to Veda Advantage and therefore could not remove the default in any event.

    The details of the matter were forwarded to the credit reporting bodies and the listing was subsequently removed.

    Summary:

    Mark had 4 defaults and one Judgment that arose as a result of a marital breakup. Mark was constantly in Family Court and was struggling emotionally and financially. All listings have been paid.

    What were any challenges with the creditor?
    When Origin provided the requested documents, it became apparent that they had not complied with the strict timeframes governing the listing of a default.  It took Origin almost a month to simply respond to our complaint and confirm default would be removed.

    Why was the listing removed?
    As this default was listed on 17 November 2014, the changes to the Privacy Act 1988 (Cth) (the Act) that took effect in March 2014 enhanced our client’s consumer rights.

    Debtor’s are now afforded enhanced levels of protection before a creditor can default list them. An additional default notice under section 21D of the Act is required to be issued to a debtor, which gives the creditor a maximum timeframe of 3 months from the date of the 21D Notice to default list the debtor should the account remain unpaid.

    Our investigations revealed the last 21D Notice issued to Mark was greater than the allowed 3 months from the date of the default. Subsequently the default was placed unlawfully and required immediate removal.

    Summary:
    Mark was referred to MyCRA Lawyers by his mortgage broker as Mark wanted to purchase his first home and his low credit score was preventing his home loan application being approved.  We were able to remove this listing in 74 days and Mark is now one more step closer in achieving his dream of buying his home.
