Credit Repair Background:
James applied for finance, but was denied due to a Panthera Finance default. James stated that he had never spoken to, received correspondence from, or even heard of Panthera Finance. Credit Repair Background:
Jeremy got behind on his credit card with St George and not long after, they changed their name in Victoria to Bank of Melbourne. Whilst this caused some confusion in making payments, they cancelled Jeremy’s card which meant he could no longer access it to make payments at atm. Nevertheless Jeremy continued to make payments to paying down the 14k balance to 7k at this point no default had been listed by the bank. In August last year, the bank sold his debt to Lion Finance who contacted him about paying the debt in full. He told Lion Finance that it was not possible but that he could continue to make regular payments as he had been doing with the bank to reduce the total. Lion Finance and Jeremy agreed to $500 a month and they also advised Jeremy that if he did not pay, this would be a bad mark on his credit file. Jeremy was surprised when he went for finance to discover that Lion Finance had listed a default against his credit file.

What were any challenges with the creditor?
Lion Finance refused to remove the default at the time of the investigation.

Why was the listing removed?
MyCRA Lawyers drafted a settlement offer to Lion Finance. MyCRA Lawyer’s raised Jeremy’s hardship (made redundant twice) and also raised Jeremy’s claims that he made a $1000 payment prior to the assignment to Lion Finance that was not correctly applied to the debt and that one of Lion Finance’s reps told him that if he entered into a payment plan he would avoid a bad credit history, even though default was already listed. Lion Finance agreed to remove the default if a lump sum payment was made before 25/04/2018.

Summary:

Credit Repair Background:
Judgment came after Rowan had built a house and got solar power installed. The house was fitted already with a digital meter, so the installers stated that Rowan did not require a meter and he should not pay for one as shown on the billing. Rowan was in dispute with CKI Utilities and asked them to visit the property to witness that another one was not installed. CKI Utilities sent court papers to Rowan but Rowan went to the court to arrange an alternate time as he would not be available as he would be away working. Credit Repair Background:
Rowan was going through financial hardship at the time and advised his creditor of his situation. He made arrangements to pay off the loan. Credit Repair Background:
Spiros had a default listing relating to a vehicle loan. He was going through a divorce settlement since 2012 when he separated from his wife and moved out of the family home. The court ordered that as part of the settlement, the car loan was to be paid out. Spiros stopped making payments on the account and advised Capital finance of the impending settlement and they indicated in phone conversations that they were okay with that arrangement. Spiros did not receive any notices of default, although he did receive some computer generated letters asking for payment on the account. Once the divorce settlement had been finalised, the Capital finance account was paid out.

Credit Repair Background:
Aaron had default listings and an enquiry on his credit file. The listings happened at a time when he admitted he was making some poor life choices that had him land in gaol.
Aaron let his creditors know he was out of work as he lost his job due to being away from work. He now works at the same place he worked at, at the time of the incident.
