Credit Repair Background:
Services Company had 2 default listings on their credit file. The defaults came about because a contractor they did work for, tried to shortpay them $1.6 million of a $2 Million invoice. The account is still in dispute. Services Company went into voluntary administration in December 2015 and a DOCA was entered into with the creditors on January 2016. Pursuant to the DOCA, a creditors’ trust was formed and all liabilities and liquid assets were transferred to the trust. There was a commitment by the Company to contribute further amounts to the trust and that obligation was completed by November 2016.

STEP 1: Determine What Account The Default Is For.

Work out how bad your credit rating really is. The best way to do this is to get a copy of your personal and Small Business Equifax, and your personal and Small Business Dun & Bradstreet credit files (see the links at the bottom for more information). Free and Paid options are available.

STEP 2: Gather All The Information First.

Review your credit files and make a note of the following:

the number and type of credit enquiries in the last 12 month period;
the number and type of overdue accounts or defaults listed;
the number of writs, judgements, serious credit infringement’s.

Also, make note of the following:

the date of the listing;
the amount of the listing;
if paid, the date paid;
the automatic deletion date.

STEP 3: Decide How You’re Going To Tackle Them.

Now that you know your credit situation and how good or bad it really is, it’s time to take action to improve your credit score.

Step three is about getting into action. Now you’ll need to negotiate with your creditor to remove the default. Don’t go in ‘guns blazing’, especially if you have a court Writ or Judgment, remember how you like to be treated.

Before you start, decide whether it’s something you want to spend the time and effort yourself to learn the legislation, find the best contacts within each creditor organisation, understand their obligations to be able to point out the errors, and then have the arguments with each of them multiple times… Or,

STEP 4: Write To The Creditor To Ask For Information On The Account.

This is where the rubber hits the road, and it might be hard going if you’re not experienced (there’s up to 8,000 pages of legislation and related reading).

You, or MyCRA Lawyers will contact your creditors individually and request a series of documents and associated information they are legally required to hold about you and your Small Business.

Belinda believes that “The Company” has improperly recorded a commercial default on her individual credit file.
Belinda worked as a self-employed contractor for “The Company” between May 2010 and December 2010. She changed her address from Suburb ‘A’ to Suburb ‘B’ in September 2010 and informed her “The Company” State Manager of the address change.
Belinda then received further “The Company” stock at her new Suburb ‘B’ address, however, “The Company” sent the invoice and subsequent statements to her old Suburb ‘A’ address.
The account was not paid and a commercial default was listed.

What Were The Challenges?
Belinda was seeking the Commercial Default Removal as she believed the listing was unfair.

Belinda had already sought help from The Office Of The Australian Information Commissioner (OAIC) and various Ombudsman bodies prior to approaching MyCRA Lawyers as both the OAIC and the Ombudsman Bodies had deemed “The Company” correct in default listing.

“The Company” was adamant that the listing was valid as they asserted Belinda had never updated her address with “The Company”, and subsequently refused the commercial default removal request at the time of the initial investigation.

Why Was The Listing Removed?
The Commercial Default Removal was achieved after MyCRA Lawyers evidenced “The Company” had in fact been notified of Belinda’s change of address and then went about conclusively proving both the change of address and “The Company’s” knowledge of the change.

A Deed of Settlement and Release was then drafted, signed and executed to confirm the wishes of both parties.

Summary
Belinda was referred to MyCRA Lawyers by her Mortgage Broker. She then immediately engaged MyCRA Lawyers to investigate the likelihood of Commercial Default removal from her individual credit file.

The Commercial Default was listed as the direct result of her changing address with her creditor, and that address change not being updated correctly by her creditor.

Belinda only discovered the commercial bad credit default listing after applying for a consumer home loan and was declined because of the commercial default.

Credit Repair Background:

Credit Repair Background:
Kandice instructed MyCRA Lawyers that she had an account with Optus. She decided at the time to change from Optus to Telstra to bring all the phones together under one account. Due to this, she obtained a new phone and new number. At the time, she thought the account was paid in full. Kandice was unsure what the defaulted amount was for however, it may have been the payout for the phone. She was not contacted by Optus by mail, and only found out about the debt when she was contacted by Commercial Credit Control. Kandice tried to go to the Telecommunications Industry Ombudsman (TIO) but was advised by TIo to resolve the matter with Optus directly.

Optus was not able to provide the documents requested.

Why was the listing removed?
As Kandice instructed that she had not received any notices from Optus, and Optus would not provide any copies of any notices allegedly issued, MyCRA Lawyers escalated the matter to TIO.
When TIO contacted Optus regarding our complaint, Optus promptly removed the default.
