Credit Repair Background:
Rowan was going through financial hardship at the time and advised his creditor of his situation. He made arrangements to pay off the loan. Credit Repair Background:
Spiros had a default listing relating to a vehicle loan. He was going through a divorce settlement since 2012 when he separated from his wife and moved out of the family home. The court ordered that as part of the settlement, the car loan was to be paid out. Spiros stopped making payments on the account and advised Capital finance of the impending settlement and they indicated in phone conversations that they were okay with that arrangement. Spiros did not receive any notices of default, although he did receive some computer generated letters asking for payment on the account. Credit Repair Background:
Aaron had default listings and an enquiry on his credit file. The listings happened at a time when he admitted he was making some poor life choices that had him land in gaol.

Credit Repair Background:
The default happened due to a billing dispute with Telstra prior to the account being sold to Credit Corp. Telstra would not let Jack pay off the overdue bill over the time he required so he wouldn’t be placed in financial risk. Jack cancelled his contract and the amount owed continued to increase.

Credit Repair Background:
Garrie has listings on his credit file. The listings are not his debts as these debts actually belong to GDK Electrical Services. Garrie was employed by them, but the company went into liquidation.

What were any challenges with the creditor?
Axess refused to remove the listing at the time of the investigation.

Why was the listing removed?
Axess would not remove the default because Telstra told them not too. MyCRA Lawyers went to the TIO and raised fact that there is no contract so no proof of debt or consent to disclose information to a CRB. Our Law Firm also raised fact that on the DnB report, it is listed as a commercial default but on Equifax, it is consumer. Telstra also advised that the account was set up as a sole trader account but Garrie advised that he has never been a sole trader. MyCRA Lawyers raised misleading or deceptive conduct and possible fraud. Telstra then agreed to remove default.
