    Credit Repair Background:
    Private Company* had no knowledge of the overdue amount nor the service that attracted these charges. Private Company* later found out that the charges are related to directory listing of two phone numbers which they have disconnected back in June 2016, all charges related to this account were generated after Oct 2017.

    Credit Repair Background:
    Ellen had a default listing with Telstra. Ellen was originally with Optus and had issues with coverage so she cancelled the account and ported number to Telstra. Telstra promised Ellen that they could provide 100% working service to her address however they had similar issues with service delivery. She contacted Telstra’s Complaints Team and credit was applied to her account multiple times as Telstra agreed service wasn’t 100%. She was then advised that her only option was to sign up for home internet bundle and did this but had a faulty modem and was advised she would need to purchase a new one out of her own money which she did and service still did not work.     Credit Repair Background:
    Sahib Transport had their office phone, fax and a mobile phone with Telstra. For the first few months, they had been receiving two different bills for office and mobile.     Credit Repair Background:
    Mark* believed he may have made the Telstra enquiry with his ABN which is why it was a commercial default.   • Slap on the wrist for Telstra under TCP Code

    global roamingTelstra customers were overcharged over $30 million on global roaming charges between 2006 and 2012 – and under the new Telecommunications Consumer Protection Code (TCP Code), the telco giant has been issued a formal warning from the Australian Communications and Media Authority rather than a fine.  Is the TCP Code effective in asserting real power over telcos? This is an issue we have been and will be watching closely, as it is of great importance to many of our credit repair clients. We examine this case in detail.

    Customer complaints about telcos are astoundingly voluminous – with recent statistics showing there were 22,918 mobile complaints to the Telecommunications Industry Ombudsman in the January-March 2013 quarter alone.

    The TCP Code, overseen by the ACMA was devised in order to encourage better behaviour amongst Australian telcos who were doing pretty poorly in many areas according to the ACMA’s report into their extensive telco inquiry, Reconnecting the Customer.

    Since the new TCP Code was registered in September 2012, the ACMA has been checking the compliance of telco providers with key new consumer protections – including new advertising rules, the requirement for Critical Information Statements and the requirement for providers to submit their own compliance assessments to industry body Communications Compliance.

    The ACMA reports it has:

    Made over 330 inquiries with providers about TCP compliance issues

    Issued 8 Formal Warnings and

    Given 3 Directions to Comply.

    The Telstra case is a significant example. The case in a nutshell, was reported by Adam Turner for Brisbane Times:

    Australian Communications and Media Authority has let Telstra off with a warning after the telco waited three years to investigate a billing error through which Australians travelling abroad were overcharged by about $30 million for services. About 260,000 customers were affected by the error between 2006 and 2012, caused by incorrect data-usage details being passed to Telstra by a data-clearing warehouse used by international carriers. As a result, some Telstra customers paid the 50¢ flagfall fee more than once each time they used mobile data on their phones while travelling.

    Customers raised concerns in 2009 but Telstra failed to investigate the problem until 2012, when it reported it to the ACMA.

    The ACMA report found Telstra in breach of the Telecommunications Consumer Protection Code, as the global roaming billing errors after 2009 were attributable to the telco’s failure to investigate the problem.

    ACMA found Telstra in breach of the consumer code, but it has the power to issue only a warning rather than a fine.

    Some have argued after the final TCP Code was approved by the ACMA, the end result was a fairly watered down Code with no ‘teeth’ to exert real penalties for breaches. In addition, the Australian Communications Consumer Action Network (ACCAN) issued a statement in July criticising the ACMA for not penalising telcos who breach the code.

    “The ACMA investigation shows telcos are in breach of the TCP Code on a daily basis,” an ACCAN spokesman said.

    “We are encouraged to see the ACMA investigating these breaches. However, the regulator’s unwillingness to hand down even the most basic available penalty for confirmed breaches has the potential to create a culture of poor compliance.”

    This may pan out to be largely right, but this Telstra case may not be the one to base that judgement on. The ACMA went into detail in a release to the media about why it chose to only warn the telco:

    The ACMA’s decision on this occasion to formally warn Telstra for the breach took into account the facts that Telstra was not the original cause of the problem; that this was the first time a billing issue of this nature had been investigated under the TCP Code; that Telstra itself reported the matter; and that Telstra appears to be otherwise currently compliant with the relevant parts of the TCP Code 2012. Importantly, Telstra proactively implemented a comprehensive program of compensation that mitigated the harm for affected customers.

    However, it does highlight the culture of difficulty when it comes to customer complaints which was so evident from the ACMA’s original investigation into the behaviour of Australian telcos across the board, and which has been an issue amongst our telco credit repair customers.

    ACMA chairman Chris Chapman said in his statement to the media the situation highlights the need for telcos to take customer complaints more seriously.

    ”Our investigation makes it very clear that all telcos need to listen to their customers who report billing problems and be vigilant about any potential issues with the information provided to them by third parties,” he says.

    The ACMA’s focus over the next quarter will be on checking compliance with the new requirement that telco providers notify customers on included value plans when they have used 50%, 85% and 100% of their included allowance. This was another major complaint coming out of the ACMA’s Reconnecting the Customer report and one which has also impacted the credit files of telco customers.

    We will be watching really closely how this pans out, and reporting on the positive and negative ramifications for consumers and their credit files.

  • Telstra’s at it again. And this time it may affect YOU.

    Your credit file could be affected by errors in the telecommunications industry…here is a media release we sent out last month about a significant data breach which occured with Telstra’s customer files. We are eager to see what the Privacy Commissioner’s findings will be on this incident.

    A massive data breach of Telstra’s customer database has potentially put around 800,000 of its customers at grave risk of having their passwords stolen and their personal information pilfered by identity thieves.

    The data breach which occurred last Friday, saw detailed personal information which was supposed to be available to Telstra customer service agents only, exposed and openly accessible on the internet.

    The Sydney Morning Herald reported on Friday a user of the Whirlpool forum stumbled upon the “Telstra bundles request search” page after doing a Google search for a Telstra customer support phone number they were told to contact.[fusion_builder_container hundred_percent=”yes” overflow=”visible”][fusion_builder_row][fusion_builder_column type=”1_1″ background_position=”left top” background_color=”” border_size=”” border_color=”” border_style=”solid” spacing=”yes” background_image=”” background_repeat=”no-repeat” padding=”” margin_top=”0px” margin_bottom=”0px” class=”” id=”” animation_type=”” animation_speed=”0.3″ animation_direction=”left” hide_on_mobile=”no” center_content=”no” min_height=”none”][i]

    SMH reported the information of any Telstra customer was searchable even by last name, bringing up the customer’s account number, what broadband plan they were on, what other Telstra services they were signed up to and notes associated with the customers’ accounts including in many cases their usernames and passwords.

    There were also other details about technician visits, SMS messages sent to private mobile numbers and credit check details.

    Telstra has reportedly reset approximately 60,000 customer passwords as a precaution.[ii]

    Telstra bundle customer, Graham Doessel is one of those potentially at risk.

    He also happens to be the CEO of a company dealing in credit repair for people who have been unlawfully blacklisted from borrowing facilities. He says as much as 50% of his clientele who present with credit file errors and inconsistencies are Telco customers, and many of those are Telstra customers.

    “This data breach is a crucial example of how errors occur so easily in the Telco industry. Unfortunately they have the potential to severely damage someone’s financial future.”

    “Every day we deal with customers who can’t get a home loan, because their credit rating is damaged by improper execution of policies and procedures in the Telco industry,” Mr Doessel, of MyCRA Credit Repairs says.

    Mr Doessel is concerned he is amongst those Telstra customers whose personally identifiable information may have been viewed, and copied for purposes of fraud during the time the information was readily available on the internet.

    “The issue is about both our possible stolen passwords, and our possible stolen personal details – a huge commodity for fraudsters. What’s to say fraudsters haven’t jumped on the internet while this information has been available and copied it?”

    “Personal details are the building blocks for constructing a fake identity. Once someone has fake ID documents, they can take out significant amounts of credit in the victim’s name. Often people don’t find out about it straight away and that can result in defaults from creditors and massive long term credit issues,” he says.

    Mr Doessel recommends anyone who feels they may be at risk by this data breach take a few precautionary steps to ensure their credit file is protected:

    1. Change passwords. Even if Telstra hasn’t advised you otherwise, go in and change your password. If you have that same password for unrelated accounts, change that as well.

    2. Contact creditors and advise them you may be at risk of identity theft. This will allow them to ‘flag’ your accounts and halt any suspicious activity.

    3. Check your credit file. Obtain a free copy of your credit file and check there is nothing suspicious already present on your credit file.

    4. Alert credit reporting agencies. They can put an alert on your credit file which informs you of any changes to contact details, or suspicious credit enquiries you may not have initiated.

    The Privacy Commissioner, Timothy Pilgrim made a statement yesterday:

    “I have opened a formal investigation into the Telstra data breach. At a briefing today Telstra has assured our office that the immediate problem has been rectified and that personal data is no longer accessible.

    I have asked that Telstra also provide me with a detailed written report on the incident, including how it occurred, what information, if any, was compromised and what steps they have taken to prevent a reoccurrence. I will consider all the information provided by Telstra and hope to be in a position to issue an investigation report in late January 2012,” Mr Pilgrim says.

    It is uncertain exactly what and or how much the Privacy Commissioner could determine Telstra would be liable for.

    A recent decision handed down by the Privacy Commissioner only last week, saw one individual complainant awarded $7500 in compensation after a Leagues Club was found to have breached their privacy.[iii]

    This is not the first time a major data breach has occurred with Telstra. In October 2010, a mailing error saw around 60,000 letters containing personal customer information sent to other customers.

    The Privacy Commissioner found the privacy of Telstra customers was only breached in 2010 due to human error, and did not occur due to any systemic failure of Telstra’s processes or procedures, therefore they were not required to pay damages in this instance.[iv]

    Telstr has sent out 220,000 ‘botched’ letters to clients with other customers information showing what Plans, Phone numbers, even Silent Numbers  and Names of other clients.

    “I have spoken with Telstra and they have assured us they will fully co-operate with the ACMA and other regulatory agencies to minimise the fall out for customers,” Mr Chapman said.

    Mr. Timmothy Pilgrim  (The Australian Privacy Commisioner) has advised that his office will commence an investigation into the matter.

    Mr. Pilgrim went on to say, “While I welcome Telstra’s prompt advice that this incident occurred and that it has taken steps to contact affected customers, I am concerned about the amount of personal information that has been disclosed which includes potentially sensitive information such as silent numbers.”

    “Customers expect their personal data to be protected by organisations and incidents such as this are very serious. For this reason my Office will be opening an investigation into the matter today,” Mr. Pilgrim continued.

    Telstra has acted quickly to set up a hotline for its affected customers 1800 307 987.

    The Privacy Commissioner and The ACMA are all working together to get this mess cleaned up, the simple truth is the damage has already been done.  The amount of information contained in these letters could be the last piece in the Identity Theft Puzzle.”

    “There are organised gangs that actually go through peoples rubbish just looking for discarded rates notices, phone bills, credit card and bank statements, old rego papers and anything else they can use to convince the authorities that they are you,” Graham Doessel continued.

    Mr. Doessel also commented, “Once the organised gangs have come back enough times (can take many months), got the paperwork they need, they will systematically go about building a copy of your identity.  Then they can access bank accounts, get credit cards, apply for loans, phone accounts, and in some cases, buy property in your name. Some have even mortgaged or sold the family home of their Identity Theft Victims.”

    A 2007 Australian Breau of Statistics survey shows over 500,000 people in Australia have been victim of Identity Fraud, with the majority coming from Credit or Bank Card Fraud.

    You are entitled to one free copy of your credit report ever year and it will arive within 10 working days.  If you need a copy of your credit rating any sooner, you can pay a small fee to have it emailed to you within a couple of hours.

    If you do discover there are concering entries on your credit rating, you have hte right to contest those and potentially have them ammended or removed.

    Contact your creditor and ask that the items are updated or removed though we do find that unfortunately many clients are bluffed by their creditors and are unsuccessful after many months of trying.
