The commercial default was listed as Rebecca was guarantor on the loan for her then husband and his business. When their relationship came to an end, her ex-husband retained possession and control of the motor vehicle.

Rebecca first discovered the listing when she applied for finance.

What were any challenges with the creditor?
The only issues we had with this matter was in contacting St George.   The case manager was almost always ‘unavailable’.

Why was the listing removed?
We asserted that St George failed to provide sufficient default notices to Rebecca and that as no notice advised of St George’s intention to default list.

St George believed that they were not required to issue a default notice as the account was commercial and refused to remove the default despite the evidence presented to them by MyCRA Lawyers.

A detailed complaint containing our findings was drafted and escalated to the Financial Ombudsman Service (FOS). Agreement was reached and the St George Commercial Default was subsequently removed.
