MyCRA Lawyers submission to the Price Waterhouse Coopers Three Year Review of the Credit Reporting Code

detailed several areas of concern.

The main focus of this post is the alleged unlawful listing of Court data on an Individual’s Credit File.

The Privacy Act (1988) s6N(k) states:

“Credit information about an individual is personal information (other than sensitive
information) that is:

(k)publicly available information about the individual:

(i)that relates to the individual’s activities in Australia or the external Territories and the
individual’s credit worthiness; and

(ii)that is not court proceedings information about the individual or information about the
individual that is entered or recorded on the National Personal Insolvency Index; …“

It is our opinion that it is unlawful, misleading and deceptive conduct to list court proceedings on an Individual’s credit reports.

If I can ask you to just imagine for a moment, that:

You and your neighbour are discussing erecting a new fence between your properties.

The discussions break down when your neighbour demands you pay 10 times the cost to replace the fence with something similar because your neighbour wants a very fancy, unrealistic, and unnecessarily expensive fence. (or any type of financial dispute between two parties)

Next thing you know, you go to refinance your home only to discover your credit rating has been smashed because of a Court Action being listed.

You investigate to find that your neighbour filed proceedings in the local Magistrates Court for what you believe is vexatious in nature. You have no record of being served, you have not been to Court but your financial reputation is in ruins…

Just suing someone (proceedings commenced) doesn’t prove anything about their claim, let alone their creditworthiness. A Court Judgment is a more reliable indicator. That is probably why the Privacy Act (1988) specifically allows Court Judgments to be recorded.

Why Brokers MUST NOT Refer Their Clients To Unlicenced Credit Repair Agencies

Credit repair is a recent phenomenon emerging in Australia, with many unlicensed credit repair agencies popping up offering all sorts of commissions to Brokers who refer clients with bad credit histories.

However, unless your credit repairer is a *licensed legal practitioner you will not be covered under Professional Indemnity (PI) Insurance.

In this interview Darren explains why:
- You must declare your referral income to your PI Insurer; and
- You must have a formal written agreement with law firm; and
- You must refer your clients to a credit repair lawyer and not an unlicensed credit repair agency.
Darren points out a Broker referring their client to an unlicensed credit repair agency, while knowing (or should have known) they (the credit repair agency) are not a law firm and therefore not legally entitled to offer credit repair services (legal work), are unlikely to be covered by their PI insurance in the event of civil litigation action against the Broker by the referred client.

This is something that, should a client referred to an unlicensed credit repair agency get ‘miffed’ at you, could potentially destroy your business and so much more.

Massive Unemployment Spike As 2,087,00 Small Businesses Forced To Lay Off More Staff To Cope With The 50% Increase In GST

[/fusion_title][fusion_text]I see this increase in GST as potentially disastrous for many Small Businesses, and the increase would need to be immediately passed to the already struggling consumer.

This morning I read a story in the Qld Courier Mail (Federal Government Offers Deal To Cut State Taxes) which talks about Qld and Vic state governments opposing the proposed increase in GST (up by 50% from its current 10%) to a massive 15%.

Will Increasing The GST to 15% Give You A Bad Credit Score?

Sure, the Federal Government is suggesting a cutting of the Payroll Tax and Stamp duty, but has anyone actually done the numbers to see how it would affect the largest employer in Australia – Small Businesses?

A small business that turns over say, One Million Dollars ($1,000,000.00) per annum (or less) is unlikely to ever see any real benefit from the cuts in payroll tax or stamp duty but will feel an immediate impact with the GST increasing by 50%.

If that Small Business was paying 10% GST on all income now, the additional $50,000 it will need to find when the Federal Government hikes up the GST to 15% is equivalent an entire annual salary for another struggling Aussie Family. If the Small Business does not add the 5o% Tax increase to its’ prices, it’ll likely have to lay off another staff member.

This means more people hurting, more households living below the poverty line, more credit card bills going unpaid, more bad credit ratings.

What your clients should know about credit repair

As a former broker, I know the hills you often need to climb to get deals over the line. One of those obstacles can be bad credit. When everything else stacks up – bad credit can be a deal breaker.

So naturally at some stage as you struggle with clients who would qualify apart from their bad credit, you may find yourself considering credit repair and its benefits to your clients.

So what is credit repair? For those that don’t know, credit repair is working on behalf of a client to assist in disputing an inconsistent credit listing or listings. Credit providers will only make corrections in accordance with the Privacy Act 1988 (Cth).

The information on the client’s credit report must be inaccurate, out-of-date, incomplete, irrelevant, or misleading to be removed. A credit repairer’s job is to find and argue inaccuracies in credit reporting.

I would love to say that every firm educates clients and brokers in this way. But in reality there are a whole ton of broken promises, misleading statements and at times out-and-out lies permeating the industry.

This can make it harder for clients to find those firms which have genuine skill and experience in the industry and who will act with ethics and integrity. Some brokers have a direct referral system with a reputable credit dispute firm for that reason. But if you don’t, how do you make sure your clients aren’t going out there blindly and making costly mistakes?

Here’s what your clients should know about credit repair:

1. Cheaper does not mean better

The cheaper the price, the less work that is probably being done on the credit file. We allocate about 28 working hours to each case because that is the average time frame involved if the job is done correctly.

2. Nothing is guaranteed

There are no guarantees with this type of work, but a firm should not take on someone they don’t believe they have a good chance of helping. This comes down to having trust in the firm you are recommending as well as the firm having a rigorous assessment stage. Clients should also be looking for published success rates and testimonials as evidence of a firm’s success.

3. Get it right the first time

Your clients may only have one chance to get it right. When clients have already used another company or have done some of the work themselves, it can place limitations on their case.

4. The ombudsman should be the last resort

Any credit repairer worth their salt should have access to more avenues of investigation and dispute than what an industry ombudsman can provide. They should be pursuing these before seeking an ombudsman’s assistance.

5. Beware of imprints

Be careful of firms which leave imprints on the credit file, as this could instantly undo all the work done in removing the credit listing.

6. Lawyers can help

A law firm will have the added protection of a state law society. A lawyer can act in court processes including the removal of judgment and writ services, which is something a non-lawyer can’t do. A lawyer can also identify and advise on legal issues; prepare binding agreements, conduct formal negotiations and then follow through with enforcement where necessary; make formal recommendations to credit providers making reference to the law, and make representations on their client’s behalf.

While credit reporting mistakes continue to come up on client credit files, there will always be a place for skilled credit reporting advocates in the finance industry. As brokers, more education about credit reporting can give you the power to contribute to a solution for the credit repair industry, and assist in minimising the current problem.
